I just received a $600 check in the mail from Bosch. My lease is up in December. Wonder if I’ll get the other $1,000 from Audi though I doubt they’ll have an approved fix by the time I turn in the car and will I get the $600 as well...

The real kicker(right in the keister) is that the funds deposited will not be available until 09/29/2017, ha, ha, ha. The joke is really on us.

Huh? If I deposit my check, my bank will make it available right away. Not sure what you mean by not available until the 29th.

Was at my dealer this week all is quiet regarding the fix being approved by carb

Just seems odd that there is no insight as to what is happening

The dealers are so disconnected from this issue. It is like they couldn't care less, or were told to play dumb when owners bring it up. My money would be on some type of delay this November, likely for good cause. At this rate, we're at least a year, maybe two years away from having to have any fix implemented.

Ok so I went ahead and deposited mine to, cleared immediately. However I did write on the back below my signature "For deposit only. Amount is 1/2 agreed payment by Bosch"

Not that anyone cares, just being a wise guy.

I just got off the phone with Bosch. They told me we will get the rest of the Bosch payment when the fix is approved, mirroring the VW settlement payout methodology. To hear it yourselves call the direct line 503-350-5800.

Until it's approved or until we accept the fix and have it installed (which is what the VW settlement requires)?

I called them back (because their 72 hours to research and respond means nothing) and they said the same thing. The VW 1/2 payment triggered the Bosch 1/2 payment and when VW pays the second half, it will trigger a second check from Bosch. Which means regulatory approval and then installation.

I don't believe the Bosch settlement allows splitting the payment. I see nothing in the final agreement that authorizes a split in the payments or any conditions impacting the payment; refusal to take the repair should have no bearing, let alone waiting for CARB to approve a fix. This is from their "long form notice" and specifies "a payment". A... single. Not multiple payments or conditional upon a fix being approved or installed. Maybe it's time for a bunch of calls to the class counsel?

I know there is a deadline to have an approved “fix”. But, it would be nice to have a deadline for implementing the fix.

Dear XXX,

Thank you for your correspondence.

There are a couple of reasons why you may have received a partial or split payment in the Bosch Settlement.

One reason is that your Eligible Vehicle claimed in the VW Settlement or Bosch Settlement is a Generation 3 2.0-liter vehicle and is currently in the two-part Approved Emissions Modifications (AEM) process. If you completed the first part of this process, you are eligible for 2/3rds of your allocation in the VW Settlements and 2/3rds of your allocation in the Bosch Settlement. You will receive the remaining third of your allocation in the Bosch Settlement shortly after you receive the 1/3rd supplemental payment in the VW Settlements.

Additionally, there is a 3.0-liter AEM (or ECR) that has not yet been approved on Generation 2 vehicles. If you were determined eligible in the VW Settlement, you would receive a “Participation Payment” that amounts to roughly half of your overall VW restitution. Likewise, your payment in the Bosch Settlement was roughly half of your automatic payment to mirror to that process in the VW Settlements.

Another reason why you may have received a split payment is because any Current Owner who purchased their 2L or 3L vehicle after 9/18/15 will receive half payment of their total Eligible Bosch Settlement payment when their approved claims in the VW Settlement or in the Bosch Settlement have been identified eligible for payment in the Bosch Settlement. The Current Owner who purchased their 2L or 3L vehicle after 9/18/15 will receive their Supplemental Payment at the end of the claims period (April 30, 2020), if no Former Owner or Former Lessee has perfected their claim for the Eligible Vehicle, at that time.

Current Owners who purchased on or before 9/18/15, will be paid their full allocation (not withstanding cases of AEM partial payment). In cases where there is a Former Owner/Lessee who has filed for the Eligible Vehicle claimed, the Current Owner will be paid half of their eligible Bosch Settlement payment at the time their VW Settlement Claim or Bosch Settlement Claim has been identified as eligible for additional compensation in the Bosch Settlement.

The Current Owner will receive the other half of their eligible Bosch Settlement payment if and when the Former Owner’s claim is withdrawn/cancelled in the VW Settlement (if determined that it is not possible to have a Former Owner for the Eligible Vehicle on the claim).

It's no surprise. Why create separate letters for the same question(s) over and over again. The response covers every possibility.

The simple answer is - wait.

The wildcard is the modification approval. VW has 2 chances with the EPA. It would be nice if they miss the 11/2017 deadline and it triggers another $500 for us, then again on 12/2017 and ultimately, the buyback. The money train is going to keep on coming. Either way, we all win.

It just is what it is, either roll with it or get worked up over money that will eventually come.
