Sure. He's been a customer for years. He's shocked to learned that the performance of a Porsche makes the emissions greater than a Toyota Prius. Where have we heard something like this before?

I'm no lawyer but that reads like a whole lot of coulda woulda shoulda. I didn't see Sport Chrono mentioned once in the document - so where does that come from?

Wow, I just read the lawsuit. Sounds like a pretty convincing argument. Of course, there are always two sides to the story and it will be interesting to see what Porsche/VW has to say.
Assuming this is all or mostly true, looking forward, what did VW do for its affected car owners? Did they give options such as buying the car back versus car modification to make it comply with environmental standards?
For me, for as much as I love my 991.1 GTS cab, I would not keep the car if it were neutered. I would rather cash out, assuming the offer is reasonable. Really, I'd just like to keep the car as designed and as sold to me but I am afraid that I will not be able to renew the car registration in California if and when the car goes on the list of recalled vehicles.
For the time being, I need to put on as many miles as possible in the car! Touring - go back to your garage! Not.
Assuming this is all or mostly true, looking forward, what did VW do for its affected car owners? Did they give options such as buying the car back versus car modification to make it comply with environmental standards?

It's possible that this is the reason for all those funny magazine test results over the past several years, in which various Porsche vehicles including 911s, Boxsters, and Caymans have exceeded the factory performance specs by substantial and consistent margins.
The excerpt Rye quoted ("Plaintiffs’ and Class Members’ Class Vehicles will therefore not perform as advertised if “repaired” in this manner") is the linchpin of any lawsuit. If Porsche can remedy the emissions violation by gimping the ECU software while still meeting their original advertised 0-60 times, then there will be no damage, and the case will be dismissed.
No damage on paper, that is. Never mind that the cars are now slower and/or drive like ****, they still "meet advertised specifications." Porsche will still have to settle up with Uncle Sam, but the owners may end up SOL.

I'm trying to understand your position. Are you saying that you think Porsche caused global warming, but you still want to pile miles on your car?
Either you're convinced that Porsche is the spawn of the devil, or you're not.

He could be convinced that the plaintiffs will be able to convince the judge that Porsche is the spawn of the devil, without believing it himself. That's my fear, personally.
There's a larger political backdrop here. The EU countries are trying to shake down Google, Facebook, and other US tech companies for every Euro they can grab, often on the thinnest of pretenses. The equivalent play on the US side was to take VAG to the cleaners, to the tune of tens of billions of dollars. There is no reason to expect this trend to slack off anytime soon regardless of the political party in power. Any shenanigans on either side will be brought to light, for better or worse.
