Missed that, thanks for pointing it out.

That its gone up to 85 is also interesting. Makes the number of owners that are needed to band together a feasible number. If enough people banded together and refused the fix, that would put VAG in a bad spot. Bet they'd be willing to make additional concessions to the hold outs, at least until they break the magic number to avoid the court's penalties.

Imagine if they stocked all the parts, hired and trained more techs, bought more danish and a heavy duty cappuccino machine for the repair program and no Diesels showed up.

Too much back and forth of the fix-no fix options - Simple ? Can an owner do nothing for a year or so and then when wanting to sell or trade knowing there is a approve emissions fix - have the fix done and get both emission payments and then sell or trade the car for fear market value?

skiahh, that was my understanding as well (ref: "For Repair, I don't think there's any adjustments for mileage or options") but what about the total NADA value.

Tach Miami, I saw that example as well but still confused. Is the non-NADA options everything on the build sheet that wasn't base?

If you add Non-NADA factory options then my number goes way up.

example:

$58,251 Clean Trade Value
$61,089 Clean Retail Value

$ 9,025 Sales Tax (9.5%)
$ 2,838 Difference between two values
$ 3,596 Repair
$ ????? Non-NADA Factory Options

$15,459 (w/o Non-NADA Options or Bosch)

It seems as if the NADA Values might have already considered/included some options. The original Base Price back in 2015 according to NADA was $62,695...I can't imagine the trade-in value is $58,251. In the example I don't see where the 10% fits in.

What am I missing?

Non NADA options as shown are items of $1,000+. I would think that packages wouldn't count if it was available as a separate option.

It's based on the 2015 Clean Retail value (10% of that) and the fixed payment ($3596.74). No adjustments for mileage, color or options, I think. Even ones called out by NADA. But, since there's a range, maybe options and mileage do factor into it?

or what about the $10k+ premium plus package iirc. Or the pano roof upgrade. Or or or.... I spent a lot of $$$$$ on my car with the intention to keep it.

I suppose time will yield some more clues into: "payment totaling 10% of the vehicle’s September 2015 NADA Clean Retail Value (adjusted for options, but not mileage)"

I can't seem to get the correlation between the 10% and the examples.

^^^^ I thought I read somewhere in the settlement documents that prepaid maintenance fees would be refunded on a prorate basis.

Pre-paid maintenance is refunded on a prorated basis if there is a buyback.

It won't shake out in the fix. If they can fix it, you get to keep your expensive options, so they're not reimbursing you for them.

Correct.

There is a lot of talk here about trade in and buyback, which is not likely to happen. There is a high likelihood that VAG's fix will be approved, IMO.
