You probably won't be able to retreive the swapped parts, so get Gio's 88 suspension and go on.

If you're planning on legal proceedings, it might be wise to take pictures of everything and/or have a statement from a known expert documenting the current state.

Find this guy and let him know there are legal proceedings to follow. Small claims at the very least. In CA there is $5k limit, I think. He probably won't show and the court will provide judgment for the person who filed the court action (in this case it would be BB79 as Mike was not involved when the swap took place). Document, document, document, the events before doing so and the real verifiable costs involved. Parts replacement, three estimates for having the swapped parts R/R'd, court costs, etc. Judges love facts and verifiable figures.

I suspect this guy won't pay willingly but there are ways to make that happen too. Garnished wages etc. It never goes away until it is paid. Can and most likely will make him suffer anxiety for what he has done as well as financial consequences.

Blythe - if you do take this advice and ulitmately get resitution, it is up to you what you do with those funds, but knowing you, I suspect you'll consider offering some of it to Mike. Sort of spreads the goodwill.

Yep, a bit of a PITA to go through the legal system, but worth it. Why it is good to live in a country that is founded upon laws and the fair (most of the time) application of them to all (most again) people.

I am not a lawyer, know only of my own personal legal experiences, so I may be completely off base here, but I don't think so.

Several weeks ago I got a call from some woman who said she caught her husband Steve cheating on her for the last time. His 79 928 was in her name and she wanted me to pick it up and dismantle it for parts. It had S4 suspension.

This thread would make more sense if "Scott Guilder" turned out to be the other half of the seller's split personality, and he has been chasing him for years.

My suggestion: The seller makes the buyer/current owner whole with a partial refund, or the sale is undone and the car returned and the money refunded. Regardless of what happened in the past, he sold a bogused-up S4 and that needs to be corrected.

I know I know... if this was me I would go ballistic on the guy and probably end up in jail! But, if it was me I probably wouldn't have sold it to a stranger without cash in hand.

Mike, the best thing to do is just put it back to normal and move on. I am sure you will be able to get the parts you need here on the board relatively cheap (I believe Giovanni has some for sale). I would say leave it and go to larger priorities, or if you have some steel ball joints around put them in until you can swap out everything.

I would 'repo' the parts from Guider, might as snag the entire car and swap the parts back at your convenience.

What I don’t get is why are there so many here that expecting a refund? Maybe the North American society is so used to getting free refunds, on a regular basis that, most people think it’s their right to do so. When in fact, it’s nothing more than a business strategy that the retail industry developed to attract more customers. Unfortunately many think that this can extend to anything they buy, even used items like cars.

In this case and even at best, is a $hitty situation for both parties as none seem to be at fault. In all honesty it was up to the buyer to inspect the car before buying it and in this case, things were not noticed until after the sale. I bet everyone here that bought a 928 didn’t know all the problems or faults until after they bought their cars and really, this case is no different.
