The issue is that the parts were modified, and you would be returning a part that was altered from what they sent out.
The fact that you are throwing a CEL does not matter b/c they can refuse receiving a product that was altered.
I would have to agree @Quadcammer that a chargeback in this situation is not just unethical, but inappropriate. Curious to see how the CC responds if 2M tells them that you altered the part and that is the reason they are refusing to refund your monies.

I'm aware it was a risk. I sent him photos before I had them modified to fit, asking for a refund or replacement and he was unwilling to help. He is clearly selling a product that does not function as advertised. I even said I would be amenable to a partial refund to cover the cost of having them cut and he said no. This was before I did anything. I paid with Paypal and disputed it as "item not as described". I will undoubtedly win the dispute and I am already sending the item back to him.
I do hope you get your $$$, but once the seller demonstrates that you damaged the product I can see both Paypal and your CC rejecting your requests.
Please keep us in the loop and I hope you get your $$$. I still maintain that the most appropriate course of action would have been to just return the non-fitting cats (unaltered) and do a chargeback.

I tend to agree that you crossed the line once you altered the product. 2M can claim that damaged goods returned are not acceptable for a credit. And rightfully so. Regardless of any other defense you may put forward (bad customer service?) the fact remains that you modified/damaged (destroyed?) their product without their express permission.
I can certainly relate to your frustration in this situation, and I too hope you can somehow receive some restitution in its resolution. Let us know how it turns out.

Sorry, but regardless of any other defense, you did "modify" their product "...by cutting down the sides..." without their permission. Thus, providing the retailer a perfect excuse not to refund your money. I agree it's a bitch, considering the people you're dealing with, but you have to take responsibility for your actions.

This means that if you modify our part, it DOES NOT void the warranty. However, if your modification (or add-on) is the cause of the damage, the cost of repairs is your responsibility. For example, adding header wrap, jet-hot coating, or o2 spacers to your headers does not void your warranty, but if the wrap causes water to be trapped and the headers rust through or the o2 spacers cause a weld to fail, any repair cost is the customer's responsibility"

What does that have to do with how the catalysts function in regards to a CEL?

I would read through their warranty carefully, and back through your correspondence with them etc. and if all lines up take them to small claims court. If you outline an argument you would present in court they will probably decide it's in their best interest to just refund you the money. In my experience small businesses usually do not protect themselves properly from claims like this, and the owner can sometimes let his mouth get ahead of his legal obligations
