928S4 Rear Ended...Year from hell continues :-(

OK. They just called and indicated that they are totaling the car. Probably because I called and told her I was not happy with some of the things, like the center muffler, they were trying to reduce on the estimate. However, now they are sending the claim to the loss division. So I have no idea what $$ amount they are going to try to settle with me for. I'm guessing I'll be going for the make-up on the medical. This may take some time.

So you know, two locals got about 15k for their '87 autos, PLUS they bought the wreck back at 1 or 2k.

I don't think they will be paying out that much because of the pre-existing salvage title. last I talked to her, her estimate for repair was at about $7K. I'm thinking they will try to settle for about that much, and give me the salvage and call it a wash. Then I will have to make it up on Medical.

Did you ever find out the "limits" on the other driver's insurance? As you and others have said, you can make it up in the medical category, but this category's limit may give you an idea of what can be paid above and beyond the amount paid for the car damage. I know you're not going to roll over and blindly take what is offered, but this may tell you how hard to press. If they've got a $100,000 limit in this category, then wear them out; but if it's $5,000, you may be up against a brick wall.

Also, make sure you're not being "steered" to a body shop of THEIR choice - that's illegal.

I do not know their insurance limits. Probably $20K or more wich should cover everything. I think there is a minimal you have to carry in Virginia. Plus I think you have to carry a limit on property and on medical.

The shop was of my choosing. They negotiated some of the estimate with them.

Just got the Ins Cc's estimate of repair. $6,331.00. That put's the value of the car by their estimate @ around $9K I'm guessing.

JE, this sucks. I was rear ended atleast twice. Each time the injury in your neck builds up on the last one. The pain will go away, but years later it builds up.

The next idiot who hits me is gonna pay big, even if I"m not hurt bad, I might roll out of the car moaning call my lawyer, call my lawyer. It totally changed the way I drive. Now when I take a right hand turn. I watch my rear view mirror to see if the idiot behind me is going to slam into me, or I'll have to go straight and take the next turn. Sometimes at a light I notice the person is about to rear end the car, so I pull ahead to leave more room.

Paranoia += 1;//after hit

Get them for all you can, remember those insurance companies aren't your friends.

That's the truth. I can tell you horror stories about insurance company abuses that you don't want to know. I still worry about rear end collisions years after being hit. (Twice). My own insurance company shafted me big time and I was 100% not at fault. The other guy's insurance company attorney would sell his own mother in whoredom and laugh about it. Lie, steal and cheat. Whew! Don't let them wear you down. And then my own attorney forgets to file some papers on time and screws my case. I have some dolls and a few pins ........!!

But when you lie, thats called insurance fraud, when the insurance company lies thats called fault protection, or liability retention.
