well, there is another side to the coin... as most ins co's are public entities, they are pressured to be profitable.... since ins is a risk management business, it's mostly based on statistical models, which are used to determine everything from the valuation of a vehicle (based on average sale prices), to rates based on age, etc and even settlement offers as a % of medical expenses...
unfortunately, those little data points represent real folks, and if they have requests outside of the std deviation, it's a problem for everyone as now there is the potential to lose for both parties, since it's a zero sum game at best...
it's also a bummer cause that same model can be abused by the unsavory, as in ins. fraud scams that rely on a "standard" quick settlements that won't be scruitinized as much as a contested situation...
is there an arbitration clause in your policy? if so, that may be the quickest way to insure you get your case heard and still keep costs down...

When my truck was damaged a few years back they offered me pennies, at which point I told them that I had already looked at used trucks, and the street value was way over their offer. Then I told them that if they could find me a truck for that money I would take it, otherwise no settlement. They doubled their offer. I wasn't polite, but I was civil, I didn't back down, and they knew I was serious. I could back up what I said , and they knew that too. Keep it simple, and stick to the point, which is that you want fair market replacement cost for a good, well maintained car, and you just want what is fair, just and honorable. Hang in there. It's going to get better. Make it clear that you would be willing to settle once settlement is realistic. Once it is clear that you are in it for the long haul, things will turn around. These guys want you to give in fast. Be realistic and they may just come closer to your way of thinking. Hope you are OK bodily. New cars we can get. You, on the other hand, are unique, and we're all rooting for you. Get your money, Keep your car, then shop your repairs. There is a silver lining. You may just have to dig a little.

It's not my policy, it's the policy of the person who hit me. I don't care anymore. At this point, I'm going for $$ to have my car fixed. I want the S4 back.

Insurance is a racket.
Can you imagine buying a new 65 inch HDTV, pay for the extended warranty (insurance), it breaks right after you buy it, you take it back to be fixed on the warranty you paid for. The store treats you like ****, says its your fault and says they aren't going to fix it. The best they can do is offer you a 19 inch standard defination set that was refurbished? Then on top of it all, its a mandatory law to pay for this insurance on your TV set to begin with?
You'd be taking hostages in an electronic store if they did that. So why do the insurance companies get away with such dranconian treatment and use the small percent of customers who sue and abuse their system for reason to treat all injured parties as scum?
Its no wonder the guy with the staplier burnt the place down.

I'm in the same boat right now. Lorelei was hit while driving the family "beater" car (91 caddy, been in the family for a very long time, has 225k on it, looks new, runs perfect).
Lorelei has been in severe pain since the accident. Insurance company tried to blow us off since it was a "low speed" parking lot hit. I'm sorry, two cars going 20mph hit each other head on, it's going to hurt. They are now saying to keep all the receipts, once "healed" they will pay the bills back to us & settle for pain and suffering.
Like JE's issue, her back and neck hurting are not just going to go away all of a sudden.

There was a point in my life when I looked forward to a good car accident and hoping to get paid well, be in semi coma and retire early in life to watch Springer in a hospital bed while getting a sponge bath. Get all the good parking spots, medical pot, a electric cart for walmart, and a brand new van every year.
Not anymore, now you get ripped off and no sponge bath, do not pass go and collect 200.00

I'd have to say I never felt worse due to my injuries just a couple days ago, and I have been going to physical therapy. I'm wondering how I would be feeling had I blown off the doctors and not gotten treatment?
Today my neck is feeling better, but I have no gurantee that will last. It's all been kinda cyclic. Also, the seatbelt apparently aggravated my left shoulder which started to feel really bad about a week after the accident. Today I have some new fangled patch tied to a battery releasing an anti-inflamatory into my shoulder. Never seen anything like it.
