I just read through the BringATrailer user agreement as well. I'm not really seeing any language in there agreement that makes it binding between the buyer and seller either, or at least they have no intention of enforcing it... They do however keep you on the hook for their 5% buyers fee.

My guess is that any buyer who doesn't follow through would have a reason involving the car or the seller, creating more of a he-said she-said situation, hence BAT's likely reluctance to get in the middle of it.

BaT has mentioned it in their comments several times. If there’s a legitimate issue with the car or it wasn’t as represented, that’s one thing. But if you bid and win, they make sure as best they can that you go through with it. And, it’s not that big of a loss if you can never bid again, because you don’t have to buy a car on there. There have been several instances of people being banned for not following through. One guy bailed because he planned to import the car to Europe but it ended up being to big a hassle.

When you win an auction, Bat sends you a message with "tips to make it more likely to close the deal" or something to that effect, which suggests that a material number of deals in fact fall through.

what I meant is that I think he forgot to configure his auction to have a reserve. There’s actually an inbuilt function of eBay to advertise that the auction has a reserve and whether or not it’s been met.

BAT might be over-fluffing 996 Turbo's just a tad...Seems like they have one or two up for auction every week!
On the $42K RNM car, seems like it could have gone a bit higher given the mileage, I wonder if the dead hydraulic rams and the 'title needs to be paid off' issues put off a few buyers.
Seller stated after the auction that he was looking for 'high $40's...' and that presumably was the reserve. If it was say $48K, then that's over $50K with the premium, seller damn well should be fixing the hydraulic wing first!

Well, the default condition is that auctions normally do have a reserve, really. When they don't, it's advertised loudly in the headline of the ad: "No Reserve, 2003 Porsche 911 Turbo", etc.

Last auction I did with BaT, the reserve was a major discussion with them. They were pushing for a much lower reserve than was acceptable to me. I suppose it's possible that BaT had a lower reserve and the seller simply stated it was higher.

There have also been instances where they've covered the gap of a car that had been bid up to close to reserve but not quite, as they'd rather book the sale with the commission than let it go bad for a few dollars
