That really sucks, but unless you live in a No-fault state you can force them to rebuild the car to pre-collision condition.
A few years ago I was side swiped by a kid that was speeding through a redidental area and didn't yield right of way. It smashed the driver's door pinning me in the car (lucky for him), the rear quarter panel and bent the frame. Anyway, his insurance, AAA, refused to repair it because it was a '70 Mustang and the damages far exceeded the blue book value regardless of it being a classic car. So I went to the courthouse filed a suit against the kid and his parents. The day after they were served I got a call from the insurance company to come in and talk about the situation. I told them I didn’t want a salvaged title and wanted the car repaired and that I didn’t care who paid for it. I walked out of their office with a check for the full amount plus car rental fees and I agreed to drop the lawsuit. Car was fixed and repainted.

I have been trying to get a hold of the Ins of the One vehicle that was at fault, so I could get a rental car. But they won't call back and the voice mail said not to leave a message except claim number and phone number! The only reason for the rental is to get a bill going.
.
Another dilemma is that I own a car lot and I'm worried that "A" they won't buy the whole rental car thing. and "B" they won't give me full Value of the car because it was not registered in my name.
Also, another dilemma is that the girl only has Liability Ins. which I think is 10-20-10. I would only get 10K period for the claim, how do I get the other money??????
Please help, I need advice!

Hi Greg,
If the girl has inadequate insurance, that is her problem, not yours. Unfortunately you may have to do as Angelo did (above) and sue her for the difference.
I think having it safe in your garage is better than having it in some lot where parts disappear and additional damage appears, so agree you made the right decision there.
Not sure of the impact of not having it in your name, but suggest it doesn't matter as the value of the car is the value of the car....

My truck was totalled last September. The other driver ran a red light and broadsided me in the intersection. He had $10,000 coverage for property damage. My out of pocket expenses were $1,200 which I submitted to his company. My insurance (State Farm) submitted about $13,500 claim to his company. His company sent us each our percentage of the total from the $10,000 limit, so I got about $800. My company (State Farm) then re-imbursed me the remaining $500 to make me whole (out-of-pocket). (I recieved about $18,000 from my company for my truck) Next step will be the pain and suffering claim against his insurance. So despite his low property damage coverage, I came out OK.

Get a good lawyer and tax-em.......someone I know might as well benefit from our stupid high insurance rates!! :>) When you have an accident that is 100% fault of one party (like Rich's and this one)....its amazing how hard the at fault person or insurance try to fight?
I do SO many traffic accident reports every year......if the damage is minor we often encourage the parties just to exchange information....which doesn't put an at fault accident on the primary at fault partys record (hence saving them $$$$)....so I tell them (EVERYTIME)...."you were at fault, you will make this right and do the right thing, if you don't I will file an accident report which will put a point on your record and you will pay either way + increased insurance rates"........then about 1/2 the time the at fault moron refused to pay & gets stupid.....so I file the report....then a couple weeks later they call all pissed about the report........I remind them that they were at fault...didn't do the right thing...now they pay!!
I like how a completely ignorant to traffic laws person tries to convince me they weren't at fault........"but she was speeding then stopped right in front of me! I know its not my fault!" so I tell them "its hard to be at fault when a car was hit in the rear bumper by the front bumper of your car!" They still say "I know I'm not at fault!" So I ask them.."have you been to through 80 hours of traffic accident investigation school?" They say no & I say "I have, your at fault!"
Its fun!

I don't know the laws in LA, but I don't see how any of this affects the value of the car.
You may want to keep in mind that a claims adjuster, if motivated, could find this forum, as well as anyone else since it is public too.

OK, The Adjuster just came to look at it. we couldn't get the hood up so he said he would have to guess on certain things or take it in somwhere to be tore down. He said he may not have a database for it, he would let me know!
