928S4 Rear Ended...Year from hell continues :-(

BTDT, can't agree more w/ron, etc... was hit by a drunk w/a forerunner while I was on a bicycle, left for dead on side of the road.. somebody saw it happen, and called chp who tested the guy at 14% BAC, and denied the whole thing even w/bike scratches on his pass door!! hit limits on policy within 2 days in hosp, then after 2yrs of injury atty wasting time, settled for policy limit and took his 30%!!

no personal assets to go after, so civil was not worth the filing fees... 6mos later he hit another driver and killed her... had a "restricted" license, guess he thought it ment drink faster/gotta be home for dinner...

court is hardball, and these guys are major league pros... be careful to run the numbers yourself, cause nobody will do it for you!!

have a brother that spent 8yrs battling for being rear ended, only to win a small amnt and be left w/a bill, so make sure you can opt out of the agreement if it looks like it's going south or they can suck you dry - all while "representing" you...

rest assured your credibilty will be under fire, as will your entire life as if it matters when being rear ended/victimized... the whole process makes me sick just thinking about it... good luck/be strong but be smart...

I meant that I would have to make it up in pain and suffering. Losing my 928S4 IS very distressing to me. That portion is covered under medical, right....but what do I know. I'm no lawyer.

JE - watch out on the mental issue - you'll need to see a shrink and document your disorder, get treatment, as awards are generally a function of cost of med bills/injury level, IIRC...

mobile? sure, when my exhaust gets here and greg turns this pile of parts into a beast!! 'bout as good as it'll get - yeehaa!

What about all the time I have had to spend just trying to deal with this F-ing accident? 4 Hours from accident to realease from hospital, at least an hour of my time every weekday making calls or arranging things as a result of the accident (3 hours alone yesterday), an average of two hours to take off work to see doctors and Physical therapist .......and the time just keeps building.

John, I think that is what some here are trying to say. And I know it too. You don't usually win these things. It really depends on how sharp your lawyer is and I mean SHARP. Like the top 1% of lawyers ... think OJ Simpson and a glove completely on his hand and the words "it doesn't fit".

Absolutely essential that you document all of this time in a notebook and log in the the dates and reasons. You will be asked, probably in discovery if it goes to a lawsuit, or before by your attorney, to quantify your actual lost time as a direct or proximate result of the accident. Be as specific as possible. No doubt about it, you will be asked and the other side will expect that you won't have kept a record. Tell 'em to stuff your notebook where....well, anyway, you'll have it and that will blow them away. Multiply by your hourly rate, and if you lose business because of any of it, including any physical thereapy you might need to have, keep a record of that loss. Keep names of anyone to whom you spoke during your phone conversations and their numbers. Be meticulous.

This may be only a drop in the bucket, but many drops eventually fill the bucket - Don't forget to ask for and get compensated for a rental vehicle, even if you have another; this was your daily driver and you had to find alternate transportation. Keep up the fight!

As I said earlier in the thread and 1981Shark also cautioned, get a rental car and do NOT let it go until you are satisfied that your car is acceptable. You have no obligation to use any other car in your fleet. That is a VERY important lever you need to use.

I had a rental car. They took it away as of the 26th even though they know that I do not agree with their settlement.

Hopefully in the end, you can "break it off" in the unsurance company.

I didn't read through the most recent pages to find out your condidition. Are YOU doing alright? Like they say, "sometimes bad things happen to good people" and their Sharks....

Actually, despite PT, the back has never felt worse since this whole thing started. I'm ready to just turn it over to a lawyer. Actually, I just did.

Do you have an insurance commissioner for DC? If so, call that office and file a complaint with them re: the insurance company's refusal to allow you a rental car until the matter is resolved and your car is back in your hands.

My experience with attorneys in these kinds of matters is that they are all in bed with the insurance companies. They are mostly a bunch of castrated ****** who want you to settle without a fight because that's the safe thing to do. (No offense intended and I realize that there are sincere, competent attorneys out there; I have just never found one when I needed one). Get more than one opinion about your back and remember that you need not sign any release until you are CERTAIN that any symptoms won't return. These guys drove a vehicle into YOU, not the other way around. Before this is over, they will try to make it seem as if YOU had arisen that morning and plotted to cause this accident as a way to bring pain and suffering down upon the world. I am serious.
