PorscheAddict: Your a lawyer?, really? As a lawyer your not grasping what I've been saying? Let me know what law school you attended so I make sure my kids don't go there. My borther is a heart surgeon so I am well aware of what medical school entials. 4 years. Last year is the residency. Alot of people work hard to get into and get through all post college studies from law, medicine, MBA. And your point is?....Oh, I get it....they as doctor worked much harder then me. Sure, you can believe that if that makes you feel better.

One last thing: I don't know how good of a lawyer you are, and I frankly don't really care, but around here most of the big name plaintiff's lawyers make big bucks through marketing and good facts, not clever legal work. The biggest plaintiff's lawyer here by far was at best a C student, but it doesn't matter if you're the cream of the crop if your client got seriously injured by a solvent company, right? For all I know you are God's gift to law, just stating that wealth and success /= skill necessarily.

Either the driver made a mistake , or had a lapse in judgement! Either way so sad that 11 people were injured. Hope this all works out ok for everybody.

Fast1: You need to improve your reading comprehension. Go back and read the part you bolded again and think about it. It's much different then your hypo which follows it.
You have also obviously never heard of Tort Claims Acts which many states have. Guess what, Idaho has one. I let you discover what immunities law enforcement has which if it's anything like NJ you are wasting your time pursuing the police for failing to provide law enforcment.

Let's start with your assertion which I bolded: But when that pedestrian uses that sidewalk next to a roadway being misued to get close to dangerous conduct the previous paradym changes and changes drastically.
My argument in a nutshell is that contrary to your suggestion, no reasonable person could anticipate that the sidewalk next to a roadway at a C&C event is dangerous. To support my argument I offered two points: 1.the drivers of the cars at the C&C events that I attended did not drive recklessly, and 2. if my C&C experiences were the exception to the norm and that it is a well known fact that reckless driving typically occurs at C&C events, then I would expect that there would be a police presence to ensure public safety.
You immediately jumped to the conclusion that I was suggesting that since no police were present that they should be sued, and cited the Torts Claim Act. I neither asserted nor even implied that the police should be sued. My position is that the police were not negligent. They were not present at the C&C event, because contrary to your suggestion, C&C events do not typically pose a threat to spectators, and that the reckless driving at the Idaho C&C was atypical and not the norm.
As a lawyer you are free to make whatever charges you feel are in the best interests of your client, but you have to offer evidence to support your charges. If I'm on a jury and you want to convince me that a C&C event is inherently dangerous, then you'll have to offer a lot more evidence than the random videos in this thread.
