I found the 'Appeal' link in the 'Resolution Center', so I appealed the 'final' decision with more detail. I am awaiting another 'final' decision.
What a strange process.
In hindsight, I think it may have been better to use PayPal dispute (which has worked for me before). Once you enter an eBay dispute, you cannot do so through PP. IIRC, PP froze the funds on a bad item until it was resolved.
(edit: PP dispute looks identical now to eBay's)

I believe this is true and is another reason eBay pushes so hard for all vendors to use it. Doesn't mean legitimate complaints don't get resolved, but another reason it would benefit the community to know who this vendor is; Whether you get satisfaction or not, it would help others here from going through the BS with this seller.

If you paid you Paypal via a credit card, you should be able to use the credit card dispute resolution process. The few times I've used it, I've never lost a creidt card dispute. YMMV

The description, in large bold print, says "NEW OLD STOCK /SEALED ENDS /PART # (928 573 098 04) FITS 1980-83 ONLY NO RESERVE AUCTION".
The seller is "Dante100", if you click his "See Other Items" link you will find Roger's Genuine Leather Console, like there is some reason to lie about that? (Can't imagine...). But you've got to give the guy credit, with modern cameras these days it is not easy to take pictures with that little actual resolution and detail.
The only time I've had to resolve an eBay dispute (so far) we went the credit-card route, figuring that the bank basically worked for us (i.e. we can fire them) and Paypal didn't. They took it seriously, called a couple of times with questions, and made (what we thought was) the right decision.
The other interesting thing about disputing a charge with the CC company is that they immediately place a hold on the funds in the merchant's account. That tends to get their attention, and we have found that they became more cooperative about resolving whatever the disagreement was. I am not sure how that works through Paypal, and I don't know if it is possible to use the CC dispute process once you start the eBay/Palpal process.

I used the PayPal balance. It's a pain that you have to empty the account so that you can use a credit card, IE you are forced to use your balance, first. (I will do it for larger items.)
When I submitted the first 'Buyer Protection' claim, I was too lazy to retype, or cut and paste all of the details. They say they may read the emails sent through the system, but I was wrong to trust that they would with any care. (The seller's emails are difficult to read, and full of typos, anyway.) Lesson here is, be very detailed in your claim!

When I bought Ken's PKsn'r for air pump, it arrived in 'not as described' condition. Instead of a removable air pump bracket which facilitates easy pump removal, the bracket was welded on.
Now several months later, 928's R Us web site still shows the old product design. Same price, less features.

But you could have returned it, which is my beef with this Dante character.
Roger's website team should update his pictures (which I sent him).
One could spin the new airpump PKT by saying that the new design is stronger. It is also easier to fabricate, so the price hasn't gone up over the years. In a sense, it has become less expensive.

Well, I did contact the manufacturer and tried to return it for the earlier design, but the manufacturer stated none were available.
Sure, you could spin it that way, but that's still after the fact. Better to be upfront with product description so the buyer knows what to expect. Agree?

It sure did... we have a thread from PorKen asking advice on how to get eBay/PayPal (yes, same ownership) to do a refund. Then borland telling PorKen about an issue with a PorKen product... OT & better left to PM's
PorKen -not knowing you had a balance to use with PayPal, I was too going to suggest the CC company refund route. eBay owns PayPal and it is their own little bank. Insisting that buyers/sellers use PayPal is bordering on a monopoly or racketeering activities.
I always use a CC through PayPal -even though it is somewhat easier to do the e-bank draft (which is the PayPal default by the way -be careful)- just for this reason. I will stop the CC payment until the issue is resolved... or if the seller didn't take care of things on his own.
I would dispute with PayPal and use all of the proper wording & pictures that were left out of the eBay dispute (like factory hoses are shipped dry -not with refrigerant residue already inside. This hose is clearly used, not new). Perhaps there is someone at PayPal that doesn't feel chained to eBay and can think for themselves!
