I guess things look different if you have the seller ship on your own UPS account.
This puts the buyer in such a transaction in a pretty ****ty spot.
I can't do anything but wait and hope at this point. And I am way behind on my project, way over budget and now totally frazzeled...
And again, I am glad it is someone from Rennlist and I know Colin will take care of me. Not any of it is his fault and I am sure he has better things to do then deal with UPS.
But I just would much rather be in control. I would be on the phone to UPS 24 hours a day until I would have my check and the gearbox back. They would be glad to be done with me...

I'm sorry but I don't think this is a decent packaging job for a heavy (but small) item. It would have been safer to keep it exposed where UPS can actually see what is inside the box.
My 6 sigma black belt capstone project is on shipping damage and as someone said earlier, if you insist on complete enclosure, you'd better use a sturdy crate shell and significant amount of High Density foam inside.
Seems that windshield also often suffer from shipping damage. I'm in the process of designing an adequate crate. Hopefully it won't cost a million dollars

I am sure it could have been packed to survive a 10 foot drop on the input shaft, but then again, UPS is not supposed to simply kick boxes off the truck. They are supposed to lift them off.
150lbs is on top of their weight allowance, so I am sure it was not on top off a stack and I am also sure it didn't get damaged by setting some other 20 lbs boxes on top.
I am convinced it fell off the truck...

Regardless of the outcome with UPS, you as the buyer never received the product you purchased. Unless the seller is planning on sending you another transmission, the wheels should already be in motion for receiving a refund from the seller. You should not have to wait for UPS to pay or not pay on the claim to determine when or even if you receive your money back.
Sucks for the seller, but that's one of the costs of doing business. Seller has to battle it out now with UPS, but you as the buyer are not in that loop (as you well know, UPS won't even talk to you).
As they say, your check should be in the mail........

The seller may or may not have packaged the item properly, UPS may or may not have mishandled the shipment, those facts are in dispute and are entirely between the seller and UPS.
The seller has your money, not UPS. UPS has the sellers property and may or may not reimburse him for the damages caused in transit.
Have you contacted the seller and asked that your money be refunded yet?

Never liked UPS and I'm not afraid to tell my friends that work for them. They botched so many of my shipments both incoming and outgoing that I cringe when a company insists on using them.
I was glad to hear that FedEx came out with Ground Service a few years ago, although they're slow they get item where it needs to be as scheduled and with out damage.
I wish Colin good luck with his dealings with UPS, I'm sure it won't be fun.

Not that it helps any but in keeping with the topic.
Not so long ago I was driving behind a UPS truck. I live near a distribution center in NOVA. Anyhow I guess they were a few trucks short so they happened to be driving a blank white panel truck and not the usual brown one. The driver comes to a complete stop at a stop sign then proceeds to makes a left. The back door of the truck rolls open and literally 1/3 of the packages inside come tumbling out of the truck. Driver pulled over as soon as he saw the carnage in his rear view mirrors.
Hopefully your tranny did not experience a similar situation as there is no way that I could see it surviving a 5ft fall at 15mph looking at the way it was packaged.
My fingers are crossed that it was just a dent in the packaging and nothing serious.

It is clear that our man Colin is not going to screw Sab on this accident, so we can all calm down about that. Whether Colin refunds Sab's money before or after UPS settles the claim is another matter.
I'm banging on this gong purely out of empathy - as I mentioned before, I also found out the hard way that a purchaser/receiver has no standing with UPS when the sender/seller pays for the shipping. A ****ty position indeed! You are better off paying for shipping yourself and arranging for UPS to pick up the merchandise from the seller/sender. That way, everything (merchandise and insurance money) comes back to you in the event of a mishap.
So Colin - if you find out what happened to it, please share - we'd all be interested to find out.

I agree, I am at this point just interested what happens with UPS. I have a slight hope that the damage is only supeficial and I still get my gearbox, but I guess that is a dimm chance.
Colin assured me he'll take care of me and he is on top of it. But apparently UPS is not very organized when it comes to mishaps.
I just hope it'll all work out.

Only if it was FOB Sab's house would it be the seller's responsibility to get the goods to Sab. Most sellers would prefer to say FOB their location. In those cases, it is the buyer's property once it leaves their hands. I'm not sure if there is any case law that defines who's responsibility it is when the FOB point is not defined.
Assuming that the FOB point is the seller in this case, it then becomes a case of did the seller adequately protect the goods? If not, then the buyer can pursue the seller and the shipper for damages. But the seller is off the hook for "delivery" of the goods.
Sounds like Sab made a wise choice working with a credible seller instead of some unknown quantity.
