Typically not in property damage cases. It takes some pretty extraordinary facts to get punitives. These facts are pretty awful, but it's still a car that was damaged, and any car can be replaced. This is a slam dunk, so with the proper documentation, he should recover every penny he ever put in it, hopefully including reasonable compensation for his time spent working on it at a self-determined labor rate.

He needs to settle with you, or face serious consequences. That car is worth more than many would tell you.

Plot a course of action and follow it. Sometimes a silver lining will emerge from due diligence.

I don't know that this will make you feel any better, but I met a man with a million dollar Ferrari once. A real enthusiast, and not at all stuck up, he was driving it to get the Sunday Times. I remarked opon what a nice car it was, and he told me how much he liked it, and how fortunate he was to have it, as he had lost his first Ferrari and all his worldly possesions when his house burned down a few years earlier. He was not bitter at all, he had simply moved on.

Don't settle for less than your dream. There is a special car in your future. Look forward to it.

Ouch!! Oh man - this is rough!

Even though I'm a newbie and the owner of a 928 for less than a week, I can offer some help on the value question - after searching for a 928 for the last 18-20 months, I have learned some things about the market for these cars. I have seen at least three non-stock S4s with 30-40k miles get bid up on eBay over the $22k mark. The only one with less than 30k on it was a commercial for the value of CarFax reports. I don't have links anymore, but eBay may be willing to search their archives for you.

Isn't the possibility of a criminal lawsuit something that can be used to encourage him to pay for a true replacement?

Bad things come in threes!!!! .....im going right now and give my parts car a real good KICK!!! hope that counts.
Man that sucks,,, and to think my cars goin for paint in a week......not that im worried that this would happen to my car ( not to good to look at and all its lights and trim will still be at my house), but i would worry about someone playin in the parking lot with it.
"" O'man its a Porsche, and its got a V8....lets see what it does?"" next thing i have is a car with a mystery vibration....lol <--just found and fixed my last vibration...somewhat.

Contrary to popular belief, victims don't really have a choice about whether to "press charges" in cases like this. Either the DA/State's attorney's Office chooses to prosecute or it doesn't. Either way, they really won't need the car owner's participation to prosecute this case. This guy should and will take a deal.

What is more likely a reality is this joker, if convicted of a crime and forced to do time (which he probably won't), declaring both personal and corporate bankruptcy. Double if not triple whammy.

Make six big blow up pictures of your totalled car and put them on six signs stating the owner of this establishment took my car for a joy ride at 3am and totalled my car. Get 5 other 928 owners to go with you and on the public right of way infront of the guys shop and picket. Take out an ad, do whatever else, you have a right to exercise free speech.

Not sure what popular belief is, but I am aware that the government prosecutes criminal cases. My thought process was that the D.A. could offer a deal that included compensating the victim, rather then prosecuting.

Interesting idea. Definitely worth a shot. Based on these facts, I think the DA could ask for whatever he wants...

BTW, I'm not sure what popular belief is anymore, either.
