she is in breach of a court order so i'm very confident in my legal position - i'm just trying to limit the damage (someone stripping the car, her crashing it, car disappearing to US, etc) - when you are dealing with an addict crazy stuff happens

Once the ppsa is filed, sale will be unlikely as it would subject to the lien.

Sorry to hear about these troubles - but with the lien you are largely covered if a sale happens and if she crashes it or whatever, sounds like it would fall under insurance.

Have you reported the theft to the cops and what did they say?

It is amazing the stuff you learn when you are thrust into the middle of crap

there is a grey ground where the cops boundaries end and the legal process is underway when someone does something that is legal but illegal and needs another legal piece of paper to force the cops to prevent something that they wouldnt usually do.

For example, you dont own your passports the government does and the custodial parent has the legal right to them - if they are lost or stolen you are legally obligated to phone the police and report it - if you them learn with certainty your neighbour has them and you call the police and say you saw your neighbor holding them - the police will come out and ask bob to hand them over - bob can say to the police yes I have them but ****off and go away - and you know what, the police will say they are just pieces of paper and unless you get a court disgorgement order and then call the police to now enter bob's house and get them they cant help you

Replace passports with car in the above example and that is what is happening - but the police dont see it that way until shown a court order

for the police it is a legal matter until a specific enforcement order from a judge gives the Police the power to enter a premise to take back an object - otherwise you can show them a legal document showing you own something but that doesn't give them the ability to go get it unless the order tells them they can go get it

lean is on
hopefully can be found and returned quickly
problem is getting an addict to show up to court or find her sometimes

that is why if anyone sees the car it would be very helpful - it could be in a parking lot hiding somewhere

thanks all

The police will never get involved in a civil matter unless instructed explicitly to do so by a judge. Even then, it can be like moving mountains to get them to do anything. I've been down that road before.
