Plagiarism and graphics
So I am sitting at my desk for another day in the salt mines when my cell phone rings and the caller says: "This is Hurley Haywood". I immediately think, Oh my god another offer to co-drive in the Daytona 24 hour, (that was a joke... lighten up) Anyway he was very business like about it but said get Brumos off your car. We don't care about the graphics or #'s but remove Brumos.
I asked DeMan MS to duplicate the #60 Brumos car and it is a true duplicate all right. I think Brumos was impressed with the car...
Gordon from Autometrics (and my wife) mentioned the "copy" could be an issue. So I decided to e mail them a picture to Brumos and ask if they had any problem with me copying there #60 GT car. That prompted the call from Mr. Haywood.
I wonder if their new car sales have picked up since I started tracking the ice/Brumos/no name GT3R?

Having been involved with copyright issues for 20+ years, I understand Hurley's/Brumos' concerns. Sometimes it isn't so much what you are doing in the instance being discussed, it is the fact that if someone else can show that they didn't defend the copyright in one or more instances, then that person can get away with a more significant hi-jack of the copyrighted material/logo, etc. ....But you guys likely know all that and get it!

A couple of things.
It was very thoughtful of you to send them a photo and get them in the loop.
I can't imagine why they wouldn't want the free advertising or risk the bad PR that asking you to remove such a well known part of Porsche racing history from your car.
Is the name trademarked?
I wonder if they ask the people who have the cars that orginally ran that scheme to take the brumos off the car once it is out of their hands.
You could change it to something similar. Brewmost or something that is close enough that people would do a double take.

While they have to defend their trademark, Haywood could have explained it more personably.
Mike
That one, Buzzin Hornets and others were done to get aound the no cigarette advertising laws in Europe and elsewhere. They were done with the Benson & Hedges typeface, or one very similar.

It was nice to ask even if it brought trouble upon yourself...
Also, it was nice of Hurley to call you instead of some lawyer with an attitude telling you that you had 24 hours to remove it.
Nice car BTW.

Something about this smells like BS.
Hurley does not own the Brumos trademark, and does not make his living making calls defending trademarks. I simply cannot see him calling some club racer about a logo on a car.
