Default STUPID SPEEDING TICKET - WTF

Its 10PM , Im sitting at a red light, light turns green, I pull away from the light, 10 seconds or so later I see a police light go off on the side of the road, , immediatly pull over, guy says I was speeding, I have a puzzeld look on my face, , the speed limit is 40MPH on 4 lane main street with no cars on either side, think I was doing about 45 at most, after waiting 10 minutes while he is checking out who knows what , I get the ticket, it sayd Im doing 42 in a 40 mph zone. So I politiely ask him why he would write a ticket for doing 2 mph over the speed limit, Im not sure the radar gun is that accurate, the response was, I was accelerating, and if he did not stop me I would hae been going a lot faster, I said OK, and just left, since it was pointless to say anything else. Guess it was a slow night UGH

Anyone else ever get a 2mph over the speed limit ticket.

That is truly bizarre. You MUST contest this ticket.
You should also get a radar detector - I would imagine that these devices have saved me tens of thousands of dollars over the last 25 years.

Go to your local ticket clinic - $100 - 150 will make it go away. You could fight it yourself, but your time is no doubt worth more than $150.

He was probably pissy because he got kicked out of Dunkin Donuts.

Ugh! I can't believe that. You'd think the guy would have just asked for an autograph and gone on his way (you being Jerry Rice and all . . .).

but seriously, it's almost unbelievable. Also, can he ticket you for accelerating and "about to" go high over the speed limit?

Two miles-per-hour over the posted limit would get laughed out of traffic court in most jurisdictions.

Fight it. When you get to court, IF the cop even shows up, ask to see the calibration reports (with the dates the calibration was performed) on the radar gun he used on your car.

Case closed.

Two MPH over. I can hear the judge now.

Don't pay somebody to do this for you, contest the ticket and typically they are eliminated without you even showing up. Write a quick letter describing the situation, that you feel you were only going 40 (as indicated on your speedo), that you would be happy to appear in court to discuss this, etc. My guess is the prosecutor that reviews all contests will look at it and you will get a Nolo in the mail.

http://www.ticketassassin.com I used it and got my money back!! was going 73 in a 50ml zone...for about 3 sec's...rest of traffic was going the same speed, but I had a P!

DO NOT use your own words.....unless you are a lawyer!!! Please not guilty and request a trial by written declaration....cut and past the letter from Ticketassasin and change the street names etc.

FYI "ticketassassin.com" is specific only to California.
If you live here, great. If not, use its advice as a "guideline." It's not the same in all states.

Then he should have waited until you got, at the very minimum, 5+ mph over the limit and THEN given you the ticket...sure smells like selective enforcement to me!

Why even ticket you at 42 mph? He should have ticketed you for 182 mph just because the car has the potential!

Do NOT use the clinic for this one. Go to court, plead your case of innocence, the cop cannot justify a damn thing, and the DA will probably toss the case before you even have to speak.

Never heard of such a thing as using up one's Nolos... Here (and I think everywhere) you have two options: 1) Plea guilty and pay the fine, take your points, and 2) Plea not-guilty, which means you receive a Nolo. No other option.

You get tickets often jerry? If you have a lawyer or if not, have a friend a lawyer, call and ask. I know any one of my attorneys would first laugh and then would tell me here in my state there's no such thing... I'm also pretty confident that if the prosecutor here received a "not guilty" plea along with a letter for 42 in a 40, he'd be pretty upset at the officer for 1) Wasting his time, 2) Attempting to waste the court's time, and 3) Inconveniencing a resident. Then again - if you are getting tickets often and the officer was trying to make a point...

I'm pretty sure I read somewhere that in Florida, you have to be at least 6mph over the limit to be issued a ticket.
I also have a friend who was stopped at 101 over 70, and got a ticket.
He was a tourist from Bermuda, and the cop told him he could go over the limit up to 5mph.
I'm just surprised to hear that...2mph over the limit, what an IDIOT.
