You have a situation where you fall into a grey area on warranty. If your repair estimate is $ 5K, you should be able to negotiate that to parts cost only and ask for some goodwill. If you do that calmly and rationally and explain to them its your intent to buy more cars from them in the future, most dealers will do this. While I doubt you will get a "freebie", it should be considerably less that $ 5K. I have managed to do this several times with dealers on various issues and find that meeting halfway works pretty well for everyone.

Then file a complaint with your state DMV about deceptive sales practices at the dealership. If they marked the car as new, and did not disclose the original in service date or warranty start date then that is a fraudulent transaction.

Agreed, I'm sure there was some mileage on the vehicle as well that wouldn't make sense with a completely "new" status aswell. The vehicle's condition and listed status is not uncommon, there just needs to a conversation and get the ducks in a row.
