Credit card chargeback is the way to go. (PayPal chargeback policy)

If I was a suspicious person, I would imagine the whole eBay/PayPal Buyer Protection thing is an attempt to limit chargebacks... be comfortable using your PP balance... debit your checking account... it's cool... You're Protected!

Looks like he is selling a 'used' hose of the same type:

http://cgi.ebay.com/ebaymotors/928-P...Q5fAccessories

Maybe he sent you the used one from this auction and he still has the NOS one? Not likely, just throwing it out there...

When you pay with paypal, don't use debit *ever*. Always use a credit card, that way you can always reverse the charge with your credit card company. It's annoying that you always have to specify credit when you make a payment and have to click through the, "are you REALLY REALLY sure you don't want to use debit" statements, but should something go wrong, it's much easier to get your money back.

Ebay owns paypal or the other way around and they do not count the customer as anythink. In my last buy i got the wrong part, I now concider it part of doing business with them and pay accordingly . Its pretty nice that you ,i can trust each other here, it is.Ray

AND the PayPal / e-bay buyer protection only lasts 30 days after purchase. Couple that with USPS that won't do anything until it's been 45 days for parcel and it's easy to get "It's in the mail, you should have it any day..." which eats up the 30-day buyer protection.

I've been burned a couple of times and neither Ebay or Paypal stepped up to resolve the issue. Most recently, I bought what I thought was a set of Bosch injectors, but they turned out to be some other brand. They were advertised as Bosch and the auction only showed the Bosch box. Anyways, the seller had a stated return policy, which I followed and he agreed to refund my purchase. I sent back the injectors and then heard nothing. Finally, I contacted Ebay to file a claim. They said sure no problem and sent a shipping label to ship back the injectors after which they would refund my money. Well, since I had already shipped the injectors back before this, I was out of luck. They wouldn't accept my proof that I had shipped them back already.

Moral is, don't try to take any action on your own without contacting them (Ebay/Paypal) first and file a complaint as soon as you think there may be a problem.

That's too bad. I hope you get your money back. Ebay 'Buyer Protection' will probably note that you received something, and leave it at that.

I was going to top this thread a few weeks ago, as I saw that he had '85-'86 air intake hoses listed. These are NLA, but I'm not sure it's worth the risk. I would certainly use a credit card! Oddly, the listing said "only for 16V".

Since this thread, I don't keep any balance in my PayPal account, and buy everything, even small items, with the credit card option.

I would amend this to file a dispute with your credit card company first, then go through Ebay/PayPal. PayPal will lock the funds in the seller's account as soon as the CC dispute is filed. This puts you in a much better negotiating position.

I truly think one of the main reasons 'Buyer Protection' exists is to discourage people from using credit card disputes.

It used to be if you went credit card dispute first, the credit card company might give you your money, but paypal would close your account.

Don't wait on any shipping excuses etc, file with ebay and paypal timely, and get the process started. Very easy to stop it if something goes well, and regardless its the sellers responsibility to get the item to the buyer within the terms of service.

True, but I made the additional mistake of paying from my Paypal balance. I buy and sell on Ebay and it's easier just to use Paypal as a bank. I like to keep my hobby funds separate from my main accounts. Unfortunately though it's not as safe as has been hammered home in this thread.

Did you leave negative feedback? His last negative was 29 Dec 2011. Using for 10 years, has a 1,004 feedbacks, 99.4% positive--so he’s burned ~6 people in 10 years. Seems kind of low based on the comments here. I don't doubt he's a dirtbag, just wondering why his percentage isn't lower.

Not yet... I was going to give him a chance to make things right, but obviously after reading this whole thing I will be taking further steps when I get back to the office today. He said to ship the part back, but it sounds like that would be a mistake too.
