DFXW Mark- LOL, you sure you weren't a judge in Philly? The shennanigans you describe are very similar to the crap that goes on here.

Thankfully it's easy to get tickets fixed here though.

Since the trooper paced you (or so he said) make sure you get the maintence records of the patrol car he was driving, specifically the speedometer calibration. The more of a pain in the *** you make it, the more likely they will drop the case!

Mark (DFWX), thank you. I appreciate your remarks and an refreshed by your unrestrained and direct expression of the truth. If the presumption that exceeding posted limits results in horrible accidents was true, the highways would be littered with mangled bodies and shredded steel. The facts state otherwise. Of particular interest was the case of Montana which experienced a drastic decline in accidents when the speed limits were lifted or eliminated, and then a drastic increase when they were reinstated.

If you don't choose to use an attorney, don't walk into court expecting to prevail by questioning the officer. Remember, he has lied to you already and in a malicious manner. He has some aggenda. You don't need to know what it is. You need to prepare for trial and that means thorough discovery to expose what case the state has against you. Preparation is essential. Your goal is dismissal of the charge, because you have already admitted to exceeding the limit, (though not the charge), and may have a difficult time justifying it to a judge even if your speed was justified legally. Use the law. This is not church.

Here's a new one in Texas, just signed into law a few months ago. I don't know the exact details but when passing an emergency vehicle, you must slow down 20 miles below the posted limit. i.e. on a FWY with a 60 MPH limit, you must slow to 40 MPH. It is being enforced in the DFW area. The enforcement comes in the form of a patrol car on the side of the highway with the lights on, and no activity by the officer, and another patrol car citing cars that drive by it.

If you do decide to follow this piece of insanity on the FWYs in DFW you will surely be rammed from behind. Then the whole mess will wind up in the lap of some poor shlub and a patrol car on the side of the road. Talk about a rage inducing event, try to slow down to 60 on the FWY here, it's insane.

Mark, awesome insight view as to what goes on. Very disturbing.
Ron, I agree, focus on the goal to get out of the ticket, I will never change this corrupt troopers mind to admit he lied and screwed me.

I called the ticketclinic, they have done a ticket for me and my wife in the past. That's all they do, traffic citations. they told me to come by and give them all info and she said it can't hurt to make a written statement for the attorney, he might use parts of it to get me off.

I also remembered that I passed a toll plaza and used my Sunpass, so I am on record using a different route as the trooper stated. But who knows, since I already contested his story under four eyes, he might change it again in court. The ticket does not state the exact location, just SR93 which is where he stopped me.

I won't have to appear in court and it does not seem to be a major deal, he did not mark aggressive driving and he marked "infraction which does not require appearance in court"...

I just wish I could proof how this guy just lied and filed a false report... but I know that is not going to happen.

I just have to drive very carefull for the next 12 month.

OK,

I,m a Marine and inegrity should be high priority for a cop like it is fr me. OK we all have our bad apples and our bad days.... however this sounds completely crazy... if you can prove that this cop fruded himself before the court and comitted in essence contempt... this guy should lose his job.
A police officer should have a certain special trust and confidence... if not he needs to go... no credibility.

The main thing you may be able to get off on, is the fact that he clocked you, rather than using radar.
Timing how long it takes to catch up to someone, is hardly scientific.
It's a lot harder to contest a radar or laser ticket.
The only clocking that is fairly accurate, is when they track you from the air,
and time you between two mile markers.

But your average cop who times your speed, simply guesses.

They figure that if they had to drive 130 to catch up to you, that you must
have been doing over 100. They rarely have any kind of accurate way of
measuring your speed. It's very un-scientific. If your speed went up or
down, or his speed went up or down, while he was clocking you,
it changes the accuracy of the timing. The only legitimate way
of clocking someone's speed, is to come up behind them unawares,
and match their speed. But trying to calculate how long it takes
to catch up to you, is not accurate at all...

Would be interesting to see what his notes are as to how he calculated me doing 100 PH + coming from a highway I was never on. What was really special that he said he was doing almost 90 when he cought up to me. That sounds about right if I was doing 80 MPH. But I have never heard of anyone getting a ticket here in South Florida at 10 MPH over.

He either saw a black car speeding and took me for it, or he just needed a big ticket to complete his quota.

Sab, if you want to see his notes, you may request them by informal discovery motion. Ask for both sides of the officer's copy of the citation, and any notes or sketches he made relating to this incident. Such notes should include any conversation between the two of you. He will rely on these notes in court so you want to know what he will use to refresh his memory. (As if he could refresh a piece of atrophied bone matter.) And if the state refuses or neglects to furnish them timely, guess what? You may file a motion to dismiss and will likely prevail. Case dismissed. You need to get on this asap following or at the arraignment hearing.

We don't do any of that here.

You go, you have your trial on the spot, it takes about 2.7 minutes, the case is adjudicated right then and there, end of process.

I just beat a ticket for speeding because the officer didn't show in court. I still had to pay Court costs. No points, no problems, except I'm selling the 944. I never get pulled over in the S4, but I get pulled over for nothing in my beautful S. A lot. I guess it looks boy racer-sucker.

Of course the ticket says you don't have to show up- if you plead guilty. Glad you got the lawyer, because you are showing them you care by showing up and not swallowing it. Kick his butt.

just a happy update...
CASE DISMISSED
Not only did he not know which highway I was on he also noted the wrong infraction on the ticket. Dismissed, no court fees.
the ticket clinic rocks...
