perhaps 928ers' are a peculiar bunch as far as risk is concerned. against all odds some written advice and reasoning we did purchase a 928, an inherently risky proposition as it lacks any fallback position in terms of service and suport let alone warranty.

perhaps i loose this perspective in the wider world as i get into my 'porsche' feeling smug and intoxicated by a sense of privelege, forgetting how little the car is actually worth.

i know i sometimes get obsessed over aspects of the cars treatment by technicians or repairers feeling for all the world as if the car was still worth £70k!

Much of the world is joining us in our sorrows with law suits.

Now to just get the judges to start throwing a few more of the suits out of the court house, and a few more jureys to start saying bull ****.

IMHO, insurance co's perpetuate the blame game by being too eager to settle obviously fradulant claims, then use pay out ratios as justification to increase rates....

of course, they settle because it's cheaper than the $400/hr attys fees to fight ambulance chaser BS!!!

not atty bashing here, but there are some who will take a case no matter how immoral, fradulent or stupid, because they know the ins co will settle, and it's easy $$

our civil legal system REALLY needs a mechanism to screen the BS out...it's costing all of us way too much $$ and time to keep allowing self created "victims" to continue milking us...maybe some kind of ****-o-meter...over 5.5 and the case can't even be filed...could use it on HP, divorce and other consumer product claims too...

Sure but a good ol' natural dissaster doesn't count huh? Just really gets me going that insurance companies charge an arm and leg for insurance against earthquakes and such and then when it actually happens guess who ends up footing the bill? The government, which means every single tax payer who is required to buy said insurance.

That gets' me going as much as the state revenue collectors gets' Heinrich going.

Andy,

Ive been in business for 10 years, and one thing I know is how to read customers. Your best bet is to cover your self like others have stated with a couple of pages typed up. Send one before the kit is sold and include the disclaimer with the kit too. Then there's no hard feelings.

1) Take pertinent information of the vehicle that was verified by a paid ASE mechanic. Therefore you can recommend a kit or not, and what is typically a safer setup. If the customer chooses not to get the mechanics inspection, well then its his fault if anything goes wrong.
2) The customer must recognise that by taking ownership of this high performance modification that there is a small percentage of random situations that can inherently cause a major engine problems from using the kit. Thats just the way high performance mods go.
3) If there's a defective part that you sold under the prescribed time period of the warranty, due to a manufacturing problem, then replace it.

Obviously you cant afford to be buying engines for people when they overboosting and the head gasket blows, pistons melt and then claim they were only running 4psi, so dont even get involved in silly arguements like that. Remember, your just providing a kit, any installation help you do should be compensated in CASH, therrfore there is no trace of you doing anything.

I loved the 5 cent balsa gliders but my problem started with the 10 cent rubber band/propeller planes. Two extra bands could be added for more power without rubbing on the fuselage. Invariably I wound them tighter and tighter until the bands broke or the fuselage folded. Destroyed a hundred; learned to salvage parts and to build new models from my shoe box full. 10 cents was worth a lot more 45 years ago. Never sued ever.

Andy, I'm fifty years old now and have have an investment in my 86.5 well beyond what it might sell for and that investment doubles if my time is included at minimum wage. Your parts will help me wind tighter sooner for which I am most appreciative. Even without your help I'll probably wind at least one engine to destruction. Nobody's problem/fault or responsibility except my own.

There can only be a handful of 928's that could be serviced to absolutely stock condition by replacement of all suspect parts at any Dealer even if the owner would pay. Absolutely no repairs would be warranted beyond replacement of recently replaced parts.

All non-stock aftermarket, off-road, racing, EPA street illegal parts are only liable for repair or replacement (per the manufacturer's discretion) against defects in material and workmanship if the manufacturer cares about their reputation. Consequential damages are not accepted ever.

I very much look forward to receiving "your kit" and will gladly sign any waiver, release of or statement of stupidity regarding use. If she dies I'll resurrect her and go again.

Please feel free to summon me to court in your defense if needed. Please keep up the great effort. Thank you.

Not exactly true Shane. Sorry. Most Earthwuake insurance, when purchased, is purchased through a government-mandated institution. When an earthquake happens, only the people who PURCHASED the insurance will be recieving the indemnification, and only the monies that were put into the earthquake policy-premium-pot will be used. So yes, the government ( for earthquake) Is involved, but i t is involved OUTSIDE of the taxpayers wallet, for all intents and purposes. Now the California FAIR plan is a whole 'nuther issue, which entails what people will get if the state continues to be anti-insurance company.

Hmmm I saw everyone on this topic defending Andy. Is it so far fetched that Viribus was asking an innocent, curious question. The majority, if not all of the thread was about how a guy like Andy or a person in a biz like his can avoid being screwed by a slime ball. An that leads to questioning the integrity of the group? I think it has been proven pretty high. More than 1 place to get a SC.

Jim, you're right, and on more careful examination I see that I may have misinterpreted the whole thing.

ViribusUnits, I apologize if I was unreasonably harsh with you.

I can only speak for myself, but I may not be the only one that feels this way: For me this is a sore point. I hear of people slipping on sidewalks and suing homeowners.... burglars suing homeowners who shot them, and WINNING. People ordering hot coffee and suing because it's hot and burns, duh. I can't even remember how many things I used to be able to do but can't now because of "liability concerns".

It's become totally ridiculous; I have nothing against lawyers per se, but there are just too damn many of them and the crap they come up with to keep themselves employed, especially the ambulance chasers, has taken me way beyond disgust and contempt for their machinations.

I think most people who have spent any time doing performance enhancements to cars have caught on to the following: If you try to get 600hp out of a motor designed for 300, it will break sooner than if you didn't. If you were making that extra 300hp with a blower, and you blew up the motor, you would know that you were SOL. If however the blower failed due to some defect, you might get a new blower on warranty, but nothing more... whether or not it took your motor out when it went. Also, if you put a blower on a brand new Porsche and blow it up at 1000 miles, the dealer is going to laugh his *** off when you ask him if that's covered.

So again, sorry to be so harsh, but basically whenever you modify something you can pretty much forget about warranties.
