Hopefully they will take on the ADM dealers next.
My MSRP dealer will blacklist you if they catch you flipping--and they check. One guy thought he was being smooth selling it in Las Vegas. However, he put his car for sale before he took delivery and they obviously have a web crawler looking for vins. They not only blacklisted him, but they refused to deliver his car.

Is Porsche Fort Myers an MSRP dealer or an ADM dealer?

That's the rule, sometimes they turn a blind eye, many times they don't.

How can Porsche shut down a BAT sale? I'm curiously skeptical.
If someone gets stuck paying ADM, they should have full resale rights, IMO; no obligations. If you want to fix this, it needs to be at the start of the chain (ie dealers and ADM). But then no ADM means all the special cars go to VIPs / best clients, who drive them for 6 months / a year, and then sell them back lightly used. Is that an appreciably better situation for the "average Porsche buyer"? I'm not sure it is.

It depends on what you signed at closing and what the circumstances were around getting the car. You may be surprised at what people blindly sign in the excitement of getting their new car. There could have been a waiting period (ala Ford GT) or a first right of refusal built in. If the seller didn't pay ADM and got it as a VIP or an automotive journalist then there may be restrictions around that too. Who knows. I'm sure the seller realized that Porsche has better lawyers and deeper pockets.
I think I even read somewhere that Ford requires that you allow it to be a lienholder on title during the contractual period. I believe I saw a pink slip posted on the web that confirmed it. Crazy stuff.
