That would suck if you had to have a ticket on your record appear 16 months after the fact and then stay on your record another 3 years.

My understanding is the conviction date. I've also heard that if you make the cheque out for an extra dollar the case can't be closed and it never goes on your record. I wouldn't count on that one!

it is the date of offense that apears on your record..... that is why it helps to delay it as loooong as you can .

just found this thread.

Got a ticket (120 in a 100) in October 2007 in NS. First trial date was April 2009, 17 months later. Then had to request adjournment as I was out of country. New court date is september this year.

I should be able to use charter argument,no? As I woud have a hard time using a witness.

Also, officer copied postal code wrong on ticket, can this be used?

After reading thread, I am ordering disclosure today as well will file for notice of constitutional question.

Actually Kris i think your time frame arguement is invalid since you requested the adjournment not the court. If the court kept putting you off than that is another thing completely.

Postal code ? yours at home or where you got the ticket ? if it is your postal code i don't think it's a big deal. If he wroye where the infraction took place wrong, now you may have a case.

but I'm no lawyer , just a guy with too many tickets.

My point was the initial 17 months to the first court date, I believe that would already be considered a bit long.
Anyway, will see how it goes.

Had my court date today.

Requested disclosure. Didn't get anything. Crown prosecutor called me in to say they forgot to include one page of the officer's notes. Offered 15 over and no points.

Instead of losing another day travelling to Alexandria from Ottawa I took their offer of 15 over and no points vs. 130 over and 4 points.

I could have argued that disclosure was not received but that runs the risk of an ajournment to another day.

I know it's a conviction so I would classify this as a partial victory.

and to insurance a conviction is a conviction regardless of 15 or 115 over.

We know what he meant... but 130 over is jail in some US states. Hell some US states 40 over is jail!

Yeah I know ... although my insurance co. differentiates bw a minor conviction (49 & under) and a major conviction (50 & over)

Chances of outright victory were slim. I was basically by myself when clocked. No other cars nearby.

30 over - 4 points.

I have some ideas for next time.

Yup.

They didn't want to, and didn't, give me a copy of the radar user's manual, officer training, OPP policies etc.
