old man neri: i hear that. i've done the sleeping in the car thing at track events..and on the gatinau mountain lol. if i had a car like a bently or something comfy, i'd just toss the keys under the front seat and pass out in the back....then again these days u'd probably be mugged

do you know you can still get nabed if you are corked and behind the wheel ? even sleeping . Omar I think your key thing would work. but what if you wanted the heat on or something , or a radio .. you'd be screwed. Ian you got any info on that law ?

I remember back in high school the cops came to talk to the class about drunk driving, and they mentioned something along the lines of "care and control" of the vehicle, whereby, like you said, if you've got the keys on your possession and you're near or in the car you can still get charged. It seems to me though that this kind of thing is more to give the cop the discretionary power they need to prevent someone from drunk driving before they actually do it, or just after they've done it, which I wholeheartedly agree with. (Aside from OPP speed traps, I do believe the vast majority of cops are not crooked or just trying to make quotas.) I couldn't possibly imagine a cop would ticket you for doing something responsible like sleeping the drink off in your car, rather than trying to drive it home. Even if they did, I'm sure you could fight it and win.

^ there was an episode of everybody loves raymond where debrah gets charged for that and gets let off because the judge agrees that with her inlaws, alcoholism is to be expected.

Doesn't matter, 'intent to drive', if you're believable and the cop is nice they might let you off. If the keys however are not on you or in the car you're okay. I asked my cousin who is a Police Officer in Alberta.
That said a Nissan Maxima, previous model, is a nice car to sleep in, take off the head rests and the seat reclines all the way to the back seat. Or there's my 'party-mobile' I had a Mazda B-4000 with my racing dirt bike & downhill race bike on one side then a cot mattress beside them with a sleeping bag and a tarp to go over so I wouldn't get covered in morning dew.
