I wonder what his defense is? In cases such as this F1 would have fired off warning letters. Seems odd to get to litigation.

Perhaps Valentine should countersue F1 for putting on the underwhelming 2014 version of their racing series, with muted engines, limited fuel use and lap times up to seconds slower than previous years' pace, besmirching the F1 name around the world....

Just legal due diligence.
Not a lawyer, but my understanding is that if you do not sue for patent or copyright infringement in a timely manner, then you forgo the right to sue later.
Also, it depends on the nature of the business...
If I market "Bernie's Olde Formula 1 Cat Litter", with a generic picture of some old dude with a bad comb-over, and I'm willing to write the big legal checks, I may win.
