Ed,

I'd be interested in what you find out. As with you, I'm more worried about totalling the car, not realy about bent fenders. So far, I've just been keeping my fingers crossed and accepted the fact that I may have to do battle for compensation for a total loss. Let me (us) know. Thanks.

I was paid in full by State Farm after an "incident" at Watkins Glen- PCA DE event. I was straight with the insurance company , did not ask before hand, etc. After the review the claim they paid. Of course I had to argue( nicely , of course) over the value - car was totaled and it was almost 20 yrs old. But they did pay and i was happy with the result.

Also, I though I would get cancelled. Not only did I not get cancelled, I informed them I would be taking my new (93 RSA) on the track for future DE. They were fine with- not in writing of course.

Be happy to gibe me details if needed.

I hate to burst your bubble. Unless State Farm in NY is run differently in UT, don't count on anything? In Utah State Farm are notorious for NOT PAYING. I have been in a 6 year battle with them for medical and lost income after on of their insured hit me. My attorny gave me a story of his wifes assistant being hit and run by a State Farm insured driver, State Farm said our insured said they didn't do it so we are not paying. Perhaps from the police records they determined this, because the next thing they said was, we can't locate our insured?

Perhaps what I'm missing here is, they never pay for anyone else's damage? You know why, as they are not my insurance, I apparently have NO claim against State Farm for dragging this out for 6 years, no claim for the lifelong injury I am left with due to their denial of claim for so long.

Crooks, they are all crooks and I invite an Insurance agent to tell me otherwise.

Spoilsport!!!! Oh, well. I was crossing my fingers and ready to do battle earlier anyway. But now, I feel less inclined to get separate DE insurance.

That's the way it works. State Farm didn't run into you, that joker did. You have to get a judgement of some sort against him, then the insurance might pay.

The Joker, a 16 year old girl, late and lost for her school Prom (disaster written all over the equation). Turned in front of me, cited on the spot by the Highway Patrol. Thus, she is guilty. I hate to say it but, it's not how it works. State Farm are saying, I visited a chiropractor before the accident so THAT is their excuse for not paying. Lets forget for a minute that their own doctor is saying that the accident AT LEAST contributed to the injury and in Utah, that makes them liable. Nah, they still don't want to pay. Forget that with the Injury, I can no longer snowboard, ride motorcross and do sports of the like for fear of putting myself permanently in a wheel chair, they feel I was running that risk before because I had the injury before the accident. How it works is, any excuse they can make to not pay, they make. BECAUSE, they can wait until the jury goes out to deliberate on a judgement, they can then offer me policy limit and they are off the hook for anything else. They can wait until the final hour and not get penalized for their actions, too bad to the claiming party (me).

That's how it works!!

Damn Insurance companies!! Anyway, this is not an agressive response to you, just a few words of wisdom from someone going through the process for the last 6 years. Oh I might add that I was not a US greencard holder then, I was an Australian tourist at the time, even easier for them to reject and harder for me to chase them up.

I know of at least one payout that State Farm has made here in texas for a totalled car (older 911) at a DE event. Driver was very upfront about the incident, and IIRC he even got a very good $$ given the age of the car. Also, I believe the car had a good amount of track mods done to it (harness, roll bar or harness bar maybe?) Don't know if he was eventually cancelled, but I don't think so.

I've had a number of claims on my cars over the years (non on-track), and St Farm was VERY generous in what they allowed to be done to get the cars back to perfect condition. As long as there is no bodily injury, they usually seem pretty willing to me to pay out for the vehicle damage, you just have to stay on them.

Hmm.. all this talk about track & insurance made me read my fine print. Looks like I'm covered: [quote]We do not provide Liability Coverage for the ownership, maintenance or use of...any vehicle, located inside a facility designed for racing, for the purpose of: a. completing in, or b. practicing or preparing for any prearranged or organized racing or speed contest.

No mention of Driver's ed, since it's not racing, or practicing or preparing for racing. I also believe I'm covered for autocross, since a parking lot is not a "facility designed for racing."

What do you think? Is my interpretation within reason?

State Farm is notorious for not paying and or dragging out claims AGAINST their insured as opposed to BY their insured. Good if you're a State Farm customer, bad for the rest of the planet.

Well the letter of document says LIABILITY... Nothing about comprehensive. Your wreck car is covered under comprehensive not liablility...

,BUT...

A DE is in a "racing factility" do they might think it to be prepartation. Autcross is timed and the set-up of cones may consitite the creation of a racing faclility.

I would interpret this as "We are not responsible for liability pay to any one or thing you damage, but we still cover the damage to your own car."

Sorry to hear about all that, Peanut. Looks like you had to get acquainted with an even ummm, less likable, species - lawyers.
