Default PCA hit with $250K judgment

Page 70 of the 8/2006 Panorama is Tom Bobbit's column about some intoxicated PCA members who crashed a 908 that was on loan to PCA for a technical event back in Feb 2002. Judge held PCA liable as a bailee in June 2006. Tom promised to chase the members who took the car to make good on the claim and proposes that those members be suspended and expelled. Hard for me to believe that they have not already been expelled!

Anyone here know more about this?

I would like more details - how did they gain access to the car? Was it out in the open? I cannot imagine it would take more than a screw driver to jump start one of those.

While it sucks for the car's owner that it was damaged blaming the PCA for the action of a couple people is just stupid.

One of the "gentlemen" was the owner of the garage where the 908 was stored.

Blamed PCA b/c you go after the biggest pockets, no surprise there.

I bet the PCA guys had complete access to the car, it was probably on loan and in their care.... but what they didn't have the authority to do was to move it around drunk. Who knows.. someone has to have more info around here on this if it is that old.

So if you drop your car off at the dealership or any repair shop - the mechanic takes it out for a ride wrapping it around a tree. The shop isn't liable? This is the same kind of scenario.

It is not the same scenario. Did you read the blog that had more detailed information regarding the incident?

A local well known shop trashed a car several years ago while on a test drive They were on the hook for repairs.

I know that. I already read the article in Panorama. It seems that Hacker-Pschorr had not and the quickest way for him to become acquainted with the info would probably be through the blog.

I do not see how Hacker-Pschorr can correlate a shop crashing a car while it is in for repairs as being analagous to this case.

Bobbit's column pointed out the essential element that makes PCA's responsibility the same as the mechanics shop - a bailment was created under which PCA assumed responsibility. IANAL, but I bet that a bailment without contract pretty much puts all the onus on the bailee.
