can the garmin be mounted off to the side near the passenger vs. right in the middle of the center console as long as it is line of sight to the sky? I know they want the camera to be high and centered.

Yes, I have mounted mine in several vehicles near the passenger side A-pillar. As long as the top of the unit has good unobstructed access to the sky for the GPS antenna then it will work fine.
