Thumbs down Speeding Ticket!!

My first post on the board is a negative one.. anyway, I need some advice. Here's the story: I was driving down a hill hitting 55 in a 35mph zone. So I was riding the car down, and I seen a blue car parked inside a ditch, so I knew it was a cop, and I tried to cut my speed before the radar would detect me by pumping the brakes. Anyway, he stops me, gives me no chance to explain, writes me a ticket for $98. The ticket money isnt the issue it's the freaking INSURANCE POINTS!! I live in NJ, and I'm 17, I've been driving for a yr now, and imagine what's going to happen. Anyway, my dad just bought me a 1988 Porsche 924S, and he is totally pissed off because of the points, and he knows if I can speed in my moms car imagine what I'll do in the porsche. Anyway, I'm thinking of pleaing not guilty taking it to court, and begging the prosecutor to take my points off.. What do you guys think I should do?

Do you guys have any "driver's ed class" options there? Here in Illinois, you can plead guilty, pay an extra $50 I think, go to a 3 hour class, and get the ticket off your record. Not sure how it works there though. Remember in court it's your word against the cop's, and the cop is NEVER wrong in traffic court.

Well, my friend did reckless driving and speeding in one shot, giving him 10 points on one ticket. He pleaded non-guilty, and they took off reckless driving, and some of speeding. So, I'm hoping they can take off the points for me.. I'll do whatever it takes.

If you don't ask, you won't receive. Never hurts to try.

This is my experience from living dangerously in my younger years in NY/NJ. If you take the time and effort to contest the ticket, judges will usually award you with a little something. A few pointers in court. Don't be negative. Unless you are absolutely certain and have witnesses, don't directly contradict the police's testimony. Use extenuating circumstances excuse: I didn't see the speed limit sign, or I saw the speed limit sign and was in the process of slowing down but it was downhill, you get the idea. One thing you might have difficulty with is that some judges view a 35 mph limit sacrosanct. This limit is usually posted in relatively denser population areas where common sense would dictate that 55 mph is waaaay too fast even without a speed limit sign. Good luck.

If you get a lawyer (~$300), they can usually get the prosecuter to plea it down to a non-points infraction, but with a higher fine. It is a win-win situation, but will cost about 5x more up front.

Well, my plan is I'm going to give him a b/s story on how my parents can't afford this and that, hopefully the chump will fall for it. But if these points don't go, I won't be driving my freaking 924 anytime soon. I'm going to go to court dressed in a suit, and I'm going to see how far I get. Wish me luck.

That sounds like the dumbest move ever, I would not in a million years try that. The cop and judge don't care for how much money your parents have (or don't have) and it has nothing to do with the circumstances, you won't get anywhere with a story like that. Lying in court is a big no-no too, just do what Palting said and wish for the best.

Sometimes you just have to take responsibility.

Uh.. it may be dumb, but I'm still going to use it. If my friends got away with the story I can too. Anyway, taking responsibility is not my choice, because if I do I'm not going to be driving my 924. So, I'll wait than fight it in court.

Sure it's your choice. Anyway, while you wait for the points to come off you can save up some cash for a manual tranny for that thing!

I was caught on radar doing 56 in a 40. I plead "Not Guilty" and went to court and got it dismissed.
Your only chance may be to use "extenuating circumstances" in your defense. The judge is not there to decide weather or not you can afford the fine, but weather or not you are guilty of the violation.
In my case, I went on line and searched for advice on beating a speeding ticket and found alot of usefull stuff.
If road, traffic and visability conditions were good, you may be able to use a "maximum speed law" defense, which ( in some states ) will allow you to drive up to the state max. speed if conditions allow. This is a long shot.
In my case, I got the officer to state that he saw me and raised his gun ( radar ) at 300 feet, as I was transitioning from the fast lane to the slow lane in front of several cars, which was exactly what happened.
My defense was based on two factors: One was that before I came into his view, I was being tailgated by someone in the left lane, causing me to speed up to make a safe transition into the right lane, which the officer saw.
The second factor was that I argued that the radar gun was not accurate enough at 300 feet to pick out one car from two lanes of oncoming traffic, and that if indeed someone was going 56, it may not have been me.
The officer was so angry that the judge dismissed it, that he confronted me in the hallway afterward.
Read up on the particulars of your ticket ( radar?) and look for advice through a Netscape or Google web search. It worked for me.

Good luck...............
