Odds are huge that it's an RMS leak and not an IMS leak. IMS leaks are extremely rare on post-2005 cars (to the point of being almost non-existent). Tell the dealer he needs to fix the problem or you'll return it.
You shouldn't have to buy a car with a leak of any kind. If it's the IMS (which it's not), then it should be on them to fix it and you should walk away. If it's the RMS, then that's an easy fix. They should do it and you keep the car.
And what does "not leaking enough to warrant a repair mean?" Is it leaking or is it not leaking? WTF?
Find out the source before you make your decision - but if they make you pay for the diagnosis, get OUT.

The sales tax maybe an issue, the sales manager said he thinks he can get it refunded also. I would rather have the dealer pay to have the leak fixed. If this is not possible and I can get all the money back I will turn the car back in. Thanks for all the replies.

Sorry 09 is more than 10K. Probably 65K. Saw a nice speed yellow low mile 09 4S with full black leather at 69K. Again, not many to chose.
Get them to replace the seal and get your PPI done.

I have gotten a post purchase inspection done on the car. The car needs to have the 40k major service done, the front inner tie rods are a little loose but acceptable, the tires have 65% tread left, the battery should be replaced (age), it has hit the over rev limiter 23 times in its life and it has a leak. I had this done at the original owners Porsche dealer where all the service was done on the car. This is the same dealer that told me that the car had a major service at 36k and at that time the car was in excellent shape. The car only had 39,800 miles on it when I bought it. This which I thought was fact along with the dealer warranty was the reason I purchased the car without a PPI.
