He may not know how to stop but he's about to learn a 25k lesson. 15k to fix the damage and another 10K for dimunition of value.

After all you went through....

Somebody mentioned 'diminished value'. Do some research. http://www.diminishedvalue.com/

Simply put, if you were told what was repaired on your car prior to purchase, how much less would you have offered? DV assumes PERFECT repair- it is the intangible reduction in value that high end cars suffer after any repair.

His insurance (and the bastards at YOUR insurance) will say 'it isn't covered'. It is. (Your insurance company has decided that they will fight ANY DV claim, even if it is against another company in support of one of their insured, simply so they set no precedent- they are terrified of DV claims.)

Forget about insurance for a moment. He hit you. He is liable for ALL of your losses. Losses include 'diminished value' Your insurance coverage isn't an issue. If HIS insurance doesn't cover the money he owes you for DV, well, that is his problem.


I'd go for the throat....

That is a real shame!

I wish you well in this. I'd definitely consider the diminished value option.

I've noticed, now that I've had my TT for roughly a month now, that while it isn't necessarily a moron magnet, I've had a fair number of morons hanging on my *** thinking they're immune to the laws of physics. I generally just try to take it slow and easy, though if I have an opening I'll sometimes accelerate away and leave them holding their privates.

that is my worst fear getting rear ended by some a##hole!!! i'm sorry that it happenened to you. hopefully the engine is not damged in any way. good luck with your repairs and keep us posted..my wife btw is an insurance adjuster so let me know if we can be of some help in case you have any questions regarding your claim.
