In my particular case, the 2003 TT I bought had a very expensive GT2-type custom spoiler mounted at a set level. In all honesty, I rather like the way it looks, even if not original. I would probably not have bought it myself, but it came with the car.
But without this having already been done to my car, I'd get the E-Rams.

It's not difficult to see the spoiler from inside the car when it's in the fully raised position. The OP is interested in problems at the fully raised position, not the lowered position and not when it's in transition. It's easy to see the spoiler using the rear view mirror when in the raised position. Likewise at the lower speed it's easy to see it start moving downward from the raised position using the rear view mirror. You just can't confirm from inside the car when fully retracted.
The thing to check is if the discordance warning comes on at 75mph when the spoiler is visibly up. If so, most likely the limit switch is not detecting the position for the reasons described earlier.
