Here's the progression:

Start car.
Hit spoiler switch.
Spoiler stays up while car is running no matter what.
Turn off car. Spoiler is still up.
Start car. Spoiler stays up until speedo is over the retraction speed and then drops below retraction speed. Spoiler then retracts and functions as if switch was never hit, I.e., goes up at 75 and down at ~35.

I don't think so.

ok, thanks. so sounds like the little lady was doing doing over 35 in our little residential neighborhood.

I think it's the opposite. Spoiler was up when she drove off and LL didn't go over 35 mph which is the retraction speed.

I wanted to propose another theory that her other boyfriend drove it around the hood @ over 75 mph but it seems less likely.
