The big question is, how was the list of VINS developed? Why were the 1999 and 2000 MY cars excluded? The law firms representing the parties have the answer to this question. They negotiated this aspect of the settlement.

The two law firms have that data, and the class members should be able to review it.

Someone who is an included party should ask to see it and tell us what it says, so this whole IMSB mystery can be solved.

I assume the settlement covers '01 vehicles, for example, that were impacted prior to 10 years' service.

Otherwise, it ain't much of a win for anything older than '03...

Yup, if an owner or lessor of a 2001 or 2002 MY car paid $ to repair his car (due to IMSB) in, for example, a failure in 2006, then sold the car, he is an included party and can make a claim for reimbursement. Even if he later sold the car and does not currently own it.

Jake probably has the most comprehensive list of those persons covered and could notify them.

I'm sure the attys will do a fine job tracking people down - the number of class-action settlements attorneys track me down for that that aren't worth pursuing is amazing... with a big-ticket item, they're probably like a pack of rabid bloodhounds.

The attorneys make their money irrespective of the action taken by the class members to pursue their rights under the settlement agreement.

In this case, it looks like Porsche will pay $950,000.00 to the plaintiffs' class action lawyer's to settle this ....in its totality. That is, unless someone opts out and goes it alone as an independent action.

Porsche gets off easy on this one, attorneys fees are worth about 60 engines. (with their cores of course!)

So... does this potential settlement by Porsche end any discussion of whether IMS failure is a serious problem?

I am still confused. I just sold my 1999 C4 Cabrio 3 weeks ago. I bought the car in 2005 and had IMS failure in 2006 at 65K miles. I dont have most of the receipts but some paid checks receipts. Can I get a refund? What should I do?

You cannot get a refund as 1999 and 2000 models are not included at all in this settlement.

True. The 1999/2000 MY cars were apparently not considered defective like the 2001-2005 cars.

One thing I can assure you, the discussion will never end. But the right to sue Porsche over it does end. It's called res judicata. Look it up.

If you are a class member, contact the law firm that represents the class members, and ask to view the discovery documents. Better yet, the attorney there may even tell you what they know.

Maybe, you will find the cause of this whole debacle and we can have some informed discussions about it.

I wonder if since you are not part of this class action, you could still have the right to file and independent case if you so wish. The same could go for 997 owners 2006 - 2008. Now that some precedent is being established you may have a chance at being successful. Any lawyers out there that can confirm this? Would res judicata extend to non class members?

I'm thinking this was a shotgun technique of only kind of admitting that there are 'some' vin's affected. If enough people outside those vins yell, it'll get opened up. Look at most of the CALS or admitted expense recalls like Ford and the cruise control thing, Toyota and the dive by wire recalls etc... it'll expand. S&*^ thing is I have been looking at 02/03's and finally convinced my wife the TT would be a better idea (haha und a few more ponies to boot!)

Sold my '03 a while back and the PPI picked up a weeping IMS (again....repaired twice) so I ended up discounting the sale price by the cost of a repair - $1,500 if I recall correctly.

Guess my only option would be to opt-out and go after them myself.....have neither the time or the will for that.
