who pays for smog in CA for a sale of car?

Folks, quick question.
In CA, isn't the seller responsible for the smog when buying a used car?
So if you're buying a used car from a dealer, who's responsible for the smog fee? You or the dealer? I just took a quick look at a contract that was sent to me and there's a line item for smog. I thought it was the seller's responsibility...

Are you keeping the car in the state or taking it out of state? I don't think you have to pay the smog fee if the car is immediately taken out of state and not titled in CA. That's the way it used to be anyway...

Hmm, the car will be in state in CA.
I know for private party sales, it's the seller's responsibility. I was not aware that from a dealership is different as referenced by djantlive.
I'm actually kind of annoyed now. We agreed on the price, and I told them I didn't want to deal with any BS "fees" for this and that. It was price of the car, plus tax and DMV license fees. They apparently put on some "s/n etch" that's invisible to the naked eye on parts of the car since it's a "highline" car. Charging $289 for it. I told them I don't want it. But they did it already on the car. Now I see a line item for smog.
Document fee $80
Emissions Testing charge $37.25
Code Protection $289.00
Actually, now that I look at this "sales contract" that was sent to me, the line item for emissions testing reads like this: Emissions Testing Charge (not a government fee) $37.25
WTF!

I believe that while the seller is responsible for the car passing smog, it can still charge for the testing/certification.
What it can't charge for is the cost of bringing the car into emissions compliance.

37 is very reasonable. You should not pay for that etching since you didnt approve it. I would threaten not to buy the car to have the charge removed. They should absorb their own mistake.

Thanks for the link. But if you read the message/thread you would realize I was talking about buying from a dealer and not an individual person.
