Default First Right of Refusal

Some dealers in Canada are making 992 buyers sign a document stating that if they sell the car within 2 years, they must give the dealer first right of refusal to beat any offer that they receive. Are you guys seeing this in the US also?

That is an illegal practice. Dealer should be reported to Porsche!!!!!!!

Ferrari dealers have done this for a long time. Given the demand for 911s, it’s not a surprise that you’d start to see this pop up with Porsche dealers.

A dealer can demand such things, but you can always say no. It’s by no means a standard practice in Porsche land.

Thanks. It is a condition of sale on the contract. So, no signature, no car.

I am always happy to let someone try to beat my best offer. I would at least try to shrink down the 72 hours. I am not sure how they would know you sod the car in any event.

Same thing when you buy a G Wagon ...another ploy is they won't actually sell you the car but only lease it to you for the first two years and then the option to buy there after so you can't resell it at a higher price ..

I foresee a lot of "owners" listing their cars at $50k "AOM", and their buddies offering $50k + $1, and taking that "offer" to their dealer for that first right.

That's the easy way around it. This is really unenforceable. Though personally I would tell them no, and report them to Porsche if they attempted to take away my order over a contract detail like that. Then again I'm not intending to sell within the time limit, so it really would be a non-issue. 2 years isn't long.

How would the porsche dealer know you have sold it to someone else (within the first 2 yrs) ? I don't see how it is enforceable even if you signed.

If the ROFR is drafted correctly, that would not work. If you don't make the sale that they failed to match, the whole thing kicks back in place for the next potential sale. Again, if it is drafted correctly.

There is nothing illegal about that. I would have no problem signing that...when you go to sell your car, email the dealer and give them the option to beat your best offer, really no downside for the customer.
