i could see e-test facilities stepping in to indirectly require the "update"?? pure speculation on my behalf.... but it would seem easy for Porsche to supply vin's in question to be red flagged when e-test time comes. by simply not passing the effected vin's (thus no plate/registration in states that require e-tests), the update could be required by holding your plates/registration hostage?. again...just thinking out loud here.

Again, none of this has been very clear from day 1, just that PNA is covering their asses preemptively. Here's hoping the solution doesn't hurt performance and doesn't get forced on anyone who doesn't want it.

Several people in the original thread here stated that the manuals had been released from the sales ban. Perhaps that's not been universally applied to all situations/dealers. There just aren't enough manuals for sale to be certain but I was basing it on the anecdotes in that thread.

Might be a canadian thing. who knows.. I put a deposit on a 2012 c2s manual with sports chrono but dealership says they can't release release car until the stop sale is lifted. This was back in May 2021 ... I got a great deal or else I would have walked a d get my deposit back.

They already admitted wrongdoing and paid a big fine with VW Dieselgate. The reputation is already tainted.

If I recall correctly the lawsuit (and subsequent Stop Sale order) was brought because actual MPG drops lower than the claimed MPG when Sports Plus is engaged (i.e. only cars with Sports Chrono). If there is a software fix then it is likely designed to fix the MPG claim, and I can't help think, therefore, that it will somehow neuter the Sports Plus mode.
I don't think that would matter all that much to me. When I want to drive, ahem, enthusiastically on public roads, the Sport button is just fine and I never* use Sport Plus. That said I didn't buy the car for it's MPG, so unless the software update fix comes with extra HP they're not touching my car. No neutering thank you very much - my car needs to remain full fat, full beans and with gonads intact.
*For the record - I tried Sport Plus once and the banging redline shifts were not to my liking - plus I don't track the car, so those 'few tenths' off my Nurburgring lap time aren't needed. YMMV.
