I know in CA, other states may be different, is this would be considered a no-fault accident/loss and would not affect your rates.

but yes, 100%, get your insurance to pay out the claim to your satisfaction
let them subrogate the claim to recover their loss
and as a last resort go after the shop directly and/or their shopkeeper policy for any gap

Btw, if you're looking to replace it with a similar car, Stevens Creek has a very nice build, brand new GTSilver car with LWBs/PCCBs on it's floor at the moment. Big premium ask $90k on a $205ish build, but likely negotiable down into the $50-$75k range if you have any interest. Note, somebody sat on a fender and flexed it, so it is gonna need a minor repair, but I understand that is being taken care of by the dealership.

The analysis on the stated value policy only comes into play if the car is totaled. And from what folks are saying here, this is not likely a total loss.

977ttNorCal went through that with my side. So it's agreed value at 250K approx. damage to the car + loss of value gives you a number and then that number is looked at as a % threshold to total. So the question is $ damage, $ loss of value. The second one has much more room for a fight and where the insurance company felt comfortable (my insurance company) that the $ loss of value would be significant and permanent. We will see.

Has your insurance company appraised the damage? Have you asked the shop to filed a claim with its carrier? If so, what has been their response?

I'm curious, what was the phone call from the shop like? Was there any contrition/deep apology/begging for mercy or was it simply 'hey, your car's ready for pickup - the good news is it's putting down a ton of power'...?

Keep us up to date on this. A lot of the members here would like to hear what the total damage is on the car and what the depreciated loss of value of it is when the insurance gets the numbers.

The shop owner was very contrite.....he was embarrassed. . Not much to really say I guess, take car, hit building. Will give you actual numbers when I get them.

1. Shops adjuster is looking today/tomorrow.
2. Mine will be later in the week.

Will keep everyone posted on damage amount and depreciation offer.

Just so I'm clear, a dealership is asking $90K over for an RS with someone else's picked options AND it has a dented fender.
