OT: Please tell me if I am out of line

I am strictly asking this see if I am out of line here, not trying to bash anyone.
I sold a part on here to a member for about 300 dollars last week. He sent a personal check and when it arrived I immediately cashed it into an account and mailed the part that day, (friday). He has a good rep here so I didn't think twice. The bank clerk made no indication of any problems with the transaction and my balance was 300 more than before obviously. Over the weekend I made a big purchase almost drained that account but on monday,I am notified that his check bounced and I have overdraft charges totaling 45$ because its 15$ for every 50 that I have to draft. So now because of his bounced check I basically am selling the part for 45 less, he says he won't pay but if you write a bad check to a buisness, there is always a fee. Am I wrong for asking him to pay the overdraft charges along with the original price since that was the deal to begin with?

First of all, thanks for not naming him. We don't want attacks on the board, so you did the right thing.
However, it really, ultimately, is your responsibility to make sure that the check clears. That's common practice when selling through eBay, etc. The bank clerk has no idea if the check will clear or not. The check would have hit your account, but with a "pending" status.
If your buyer were a stand-up person, however, he would help you out.
Legally, you can't hold him to anything. Ethically, I'd hope that he'd give you the $45 - it's not a whole lot of money so it won't break the bank for him to help you out.

He needs to pay any fees that you incurred as a result of his criminal actions (writing a bad check)
Everyone has issues, and who knows what happened with his check bouncing. Maybe it wasn't his fault- maybe there was some situation that we don't know about that took some extra $$ from him? Who knows, but the bottom line is he should man up and pay any charges you got pinned with. That is the least he could do for you being such a nice guy and not faxing a copy of that check to his local sheriff's office.

Yea, what kind of consequences follow legally for writing a rubber check?
Just let him know you can look up the authorities in his town ratherly easily, if need be.

I'll chime in here with $345 too. And I think this is exactly what the forum is for.. upright relations for upright people.. if someone can't muster up that kind of character, I don't want em here.. more importantly I want to know who they are if they're staying.

Some would consider it a personal attack; however, I disagree. I too would send parts to someone on this board without thinking twice about whether the check would clear. In fact, I brought a black interior for my car and I know that the rennlist member sent them before even cashing my check.
I’d give the member an opportunity to make good on the check, as well as, your bank charges first. If he/she is not honorable I’d consider it a personal favor to let the rest of us know who it is as we all sell parts on here from time to time. Imagine how many more people would have gotten ripped off if we had not banded together and let everyone know about one now defunct vendor
