I have been working on my brothers car today "all day" but I did measure the Rear Fenders.
The drivers fender is 1/2 closer to the wheel than the passenger side. I think its the body kit but did notice some of the old fender may have been hitting the wheel I'll look at it a little closer. When I bought this car those wheels were on it for 10 years, so they must have used a narrower tire. This was the manufacturers prototype, I would think they would have not let the wheels rub.

Thought I would do a follow up:
I removed the drivers rear wheel and found a rub spot on the original inner fender. Used my drummel tool to cut out the section last night. Took it to an account today and looked for some dips and no more rubbing. I think I noticed a slight noise on the passenger side after a large dip but I'm not sure, I need a little more testing.

you could remove the shock, put the pin back through with a spacer and then move it its full range of motion to verify no interference.

I thought of that as a last resort, would be nice to not keep putting things on and taking them off again.
