Brian, I thank you for your honesty. There are exceptions of course, as with all things in life, but essentially it is as you said. If you consent or admit, their job is done.........unfortunately. We are some of the most fortunate animals on the planet to have the Constitution on our side, though for some it doesn't often seem that way. I say all of this as someone who has police officers as trustworthy friends.

Update:

I decided not to fight it and went to court today. I plead guilty and the judge fined me $100 plus 295% court fees, which came out to $495. I'm also on one year court probation, which simply means I shouldn't commit any more crimes for a year.

I asked the judge if I could go to traffic school to remove any points against my record and he said not in his court, because it's a misdemeanor, not a traffic violation.

There were two other miscreants before me with the same charge plus driving without a license, intoxicated, repeat-offense, etc.. They both got jail sentences, with the option to participate in a work program instead, which they both took.

I think my sentence is reasonable --we'll see now how much those two points cost me.

As long as you don't get anymore in from the point infraction for two years, it will not be reported to your insurance.

Trust me I know.

On what planet is this all taking place? Andre, would you please re-check your authorities on this point? If you get a citation and guilty plea or determination in Alaska, Maine, or Florida, California will hear about it AFAIK. Please correct me if I am wrong, but once he pled guilty California DMV knew about it and so did his insurance company. Who do you think is responsible for discovering how much money could be generated by traffic fines and increased premiums during the period of the National Maximum Speed Limit? (walks off shaking head mumbling obscenities to himself....!!) llAnyone here really deluded enough to think this is about safety and health? Sheesh !!! For those of you that can remember that far back, try to remember how it was before the NMSL. (mumbling more ofensive obscenities and kicking the dog.....!!)

Parson my ignorance but what is ERM? My insurance company is all over any notice from any court or motor vehicle dept. in the world. Bunch of ****** IMO.
I had to get all my premium increases back once after a three year battle in Los Altos which I eventually won. Then I billed the ****** and they refunded my money. I told 'em to get a real job and try to be of service to someone. Does anyone know anything about einsurance? What do you do if you have a claim? Get a webcam to scan the damage and submit it to their e-agent? I think I need another insurance company. I get a crummy warrant for my arrest and they get all excited about it. Sheesh !! See I told you they were a bunch of ******.

Okay you have 2 aspects of this "offense" to worry about...the 1st part is done...thats the "criminal" part that was handled by the judge (been there done that many times, as a suspect too).....NOW is the hard part...DMV will review your license status...assuming you don't have any other points on your record you should be okay....I think it takes 4 to get a suspension, but am not 100% sure....

However I DO think your insurance will find out and raise your rates BIG TIME.....

Yup!!! BIG TIME !! Count on it. For three years. An unearned profit for them and why they keep supplying radar guns to the police, and engage in other questionable actiities like spreading dirty, untrue and harmful stories about "safety" and driver behaviour to the public through vague and hard to trace avenues of communication. ******. (Brendon excepted of course)

It was indirectly for a driving thing, but directly because my attorney didn't file a paper on time or at all (not sure yet) and didn't tell me. But it was for another state. I committed a very inexcuseable act: I assumed someone would do something. Don't assume the sun will rise tomorrow, unless you know it will.

Insurance is a RACKET...plain and simple.....we pay THOUSANDS of $$$$ per year and get virtually nothing in return....& when we do they raise or rates...... sure they pay $$$$ every once in a long while..... but I'm sure all the years we didn't have any claims and still paid $$$$$$$$$$ makes up for an occasional claim

Doesn't CA have the $30k bond rule..... if you can post a bond worth $30k it will count as your insurance? I remember seeing it somewhere..... it might be worth it long term....shoot I pay $2k a year for my 3 cars....& have NO claims...nice investment for them

Yes you may post a bond for whatever amount you can muster up that is acceptable to the state, but then if you wipe out a family of ten in an SUV you may not be driving anything or sleeping inside for a LOOONG time, because what your bond doesn't cover you must cover. That's the rub with insurance and it spreads the risk among such a large segment of the population. But consider this: the insurance companies CANNOT go out of business or business will go out of the country. They MUST make a profit. How much is the question. So we have our esteemed Insurance Commissioner who really does get into it for the consumer; the insurance companies get angry because he offsets their greed and they make up their margins by raising rates for IMAGINED dangers. Health insurance rates keep rising seemingly for the same thing: "rising overhead". Hey that wouldn't have anything to do with executive perks would it?
