I am a lawyer. I have experience in copyright and trademark law. I have registered both copyrights and trademarks on behalf of clients. I can also say that there's no way for you, unless you are an intellectual property attorney or judge, to be able to say that a majority of any cases say anything.

Review the prior posts. I am not planning on doing anything. My presence in this discussion has been to do that, simply discuss. It has turned into a debate now and I regret that it is turning a bit harsh. The proposal to copy and distribute the manuals on CD came from another member of this board.

My responses are based on personal experience and a review of the statutes I've referenced.

Again, to repeat, I do not dispute that making and distributing copies of the manuals could subject the copier to claims for damages. Charging a fee increases the likelihood that such an act is a crime.

The issue may appear to be cut-and-dry to you. My position is and will continue to be that the issue is not that simple. There are arguments for both sides (assuming that there are only two sides here) and I have chosen to represent the side opposite yours.

I should have know you were a lawyer. Defending one side or the other is your bread and butter, and that's fine with me.

This whole thread struck home cause I brought up the issue of making 928 service manuals on CDs about 10 years ago. I contacted Porsche NA about my plan, which included the use of high-speed copiers that would save the copies digitally. Porsche said, not to bother, as they were in the process of having all of their service manuals and technical bulletins digitally saved by a firm in Germany. They also mentioned that they would protect their copyright from any unauthorized use. That was a not-so vailed attempt of saying - "BACK OFF! This is our turf." Who was I to argue with them?

In any event, thanks for the point-counter point discussion. If we ever do meet, let's <img src="graemlins/beerchug.gif" border="0" alt="[cheers]" />
