It did not not matter to the cops if it was a "stranger", "acquaintaince" or "friend". The defining moment for them was whether I willingly gave my keys to the individual versus having the keys taken against my will. According to the cops, this was the criteria that they used to define a civil matter or a criminal case. In my case, I gave willingly gave the keys to the individual. Therefore, it is a civil matter and not a criminal matter. This was the situation in my case.
I am sorry that it happened to Marcus H, and it could also have affected JCB. But I suspect this was the situation in Marcus H's case when he handed the keys over to Maverick Marsellis. It could explain why the cops were reluctant to press forward on Marcus' case.
Perhaps someone with a legal background can chime in on this criteria?

I am sorry but that is very hard to believe. Ift that was the law tell the cops you forgot the keys in the car and the guy drove away with it without your consent.
Why would it be different for a car dealer? Because they make a copy of the driver's license?

The situation of the stranger driving away should no way be a civil matter, IMO.

As with what AGC said, that seems to be the case. I know...its hard to believe that someone could do this. Trust me when I tell you that I went through all of the same surprises when Marcus told me all of this. None of it made sense to me. I still have his emails but will not post them due to them being private emails to me. I would ask Marcus first, but I am sure he would rather let you hear it first hand from him. I already invited him to this post. I do hope he posts just so that it will bring awareness to situations like this.
As far as dealerships, I don't know that any of them will just let you take off with a new car without a salesman. If they do, you can bet they already ran a check on your drivers license aside from just copying it. Other than that, they are so insured for ALL kinds of crap that they aren't holding their nuts everytime someone takes a car out. A major corporation has more cash to go after someone than most of us iindividually. Understand, I am not quoting laws nor do I know anything first hand, just repeating what Marcus shared with me. It took him a looooong time and constant contact with the police, hours of research, lot's of dead ends. I mean, based on all of the facts he shared with me, the cops STILL couldn't do anything. I think he even had detectives on it.

the counselor is in! Anybody who would hold themselves out as a prospective purchaser and then drive off in a "test drive" of your car is committing the crimes of auto theft and theft by deception. The fact that you gave the person the key in order to take the test drive is of no consequence. The police who said otherwise were simply lazy - it is most definitely a crime in any state. As to why this guy doesn't get prosecuted, the problem is that the victim must press charges, and frequently fraudsters like this guy is puprted to be fly just under the radar making it (in most cases) not economical or feasable to chase him down and persue the matter. He should be gone after if these circumstances are true!

Hi everyone, I guess it's my turn to chime in
on that last post about the police and going after this guy, I reported the car stolen to the police, who in the beginning blew me off because I gave him the key, first thing they asked me was, he stole it, how ? as soon as i told them I gave him the key the conversation was at an end, not even a police report, my lawyer went down to the police station that same day and hat's off to him, the police called me and told me they would give me a police report and call it "embezzelment"
I then dug up loads of info on Maverick Marsalis, real name is Derek Kelly, I hounded on the police, was assigned a detective, who I must say , looked like he was trying to help me.... cut a long story shot, in the end he went to the DA's office with all the evidence and records and photos he collected from other agencies about this crook and the DA wouldn't take the case on, something about the porno film that Maverick made with my car in it and having my name in the credits at the end of the movie and stuff like that....
This guy has no real job, he palms himself off to people as some high society guy, he has an increadable beleivable story, I talked to several of his victims, one group of people i recently met were embezzeled out of $250K ! for some porno movie deal
He trolls some of the more red light chat rooms, picks up on girls, gets them to believe his lies then takes their money "borrows the money as he puts it" so all this falls under civil law, he has a few outstanding warrants but it all minor stuff, sooner or later all this will catch him up and I know for what happened to me, I'll get my last laugh at that creep...

update on my wide body car for those who may be curious
I have removed the purple and silver ASAP interior and have replaced it with a 1991GT black leather interior, I took off the rims he had put on and brought some BBS 18x9 fronts and 18x14 rears
I am still unloading all the pimp stereo wiring, which was crap installation btw...
anyways, sorry to see he has raised his head again, I hope that sooner or later justice is done

Hey Marcus, thanks for clearing that up. I didn't want to speak for you, but I just wanted to warn others. I thought I had the story straight from what you had told me and glad I remembered it correctly. I know the story goes a lot deeper with many details, but no matter, this guy needs to go down and down hard.

There can be some interesting circumstances around this stuff - definately depends on what state you're in. My SS# got stolen recently and I was able to stop the transactions and put a lock on my credit before anything happened. I called our local PD and they said since I stopped the theft there wasn't any crime. NOw I know my SS# is out there somewhere and will have to be careful the rest of my life. It sucks.
