Talking Case Dismissed!!

Last April on my way home from the Spokane track attack and visiting in Idaho, a revenue collector pulled me over for doing 90mph in a 65. Issued me a ticket for $158. Ouch!! Not just the money but I have been with a clean driving record for so long that my insurance is rather cheap. So I ask around and Heinrich (Thanks Dude) hooks me up with his lawyer, Jeannie Mucklestone. My hearing was on the 13th and I hadn't heard anything from her so I sent a query e-mail to her yesterday. Here is her reply:
Hi Shane, your case was dismissed on the 13th. Thanks for your business!

Woooohoooooooooooooooooo!!
Cleared to terrorize the freeways once again.

I paid her $350 to do her stuff. And since I got the ticket in King County Washington, and I'm up here in Alaska, I was not able to attend. No I never paid the ticket, I just sent all the paper work to Jeannie and she took care of it. How is yet to be determined, maybe the revenue collector had crap evidence or didn't show up for court. I'll find out tomorrow.

Why didn't you just do on-line traffic school to have it removed from your record? Maybe Wash. state doesn't give that option?

I guess it is because the thought of giving anything ($'s or time) to the revenue collectors (especailly in WA) is not something I like doing. Screw 'em, if I was doing 90 in a rattle trap, rust bucket I could see the need for a citation, but in one of Porsches' finest no way!

This is not right. After all, you were speeding and were guilty of that offence. It's not like the officer framed you in any way. You should have taken responsibility for your actions and pay the ticket.

Just cause you haven't been ticketed in a while doesn't mean you don't speed regularly. You were just lucky and haven't been cought till now.

I'm sorry, but in my oppinion, this is nothing to brag about.

It all depends on the conditions.

Yes, he broke the letter of the law.

But there are many stretches of road in the US, that are completely flat, completely straight, with great visibility, and 90mph is *not* at all unsafe. Especially in a 928...

So when you decide to break the law, and speed safely, you have to deal with the chance of a ticket. And so you can either pay it, or fight it, or whatever.

If you feel you did something "wrong", and you feel you did wrong, and feel like you should pay a price, then by all means, pay your fine... But if you know anything about tickets, and law enforcement, you will know that tickets bring in millions of dollars in income. So local police use tickets, and speed traps, to raise revenue.

If people only got tickets, for dangerous driving, I would feel differently. Dangerous drivers should be punished. But if they are giving tickets, just to raise revenue, I think it is reasonable to fight the ticket, if you think you can win.

My guess is that tickets in Canada are not based on revenue as much as they are here?

Here they sit and hide, and just write tickets all day long, to make money.

They have police who's only job is giving tickets.

If police were told by their superiors, just to give tickets to "dangerous" drivers, and that is all, then I would have a lot more support for police. But they are often not out looking for criminals. They are just sitting in the bushes, with a radar gun, giving tickets out all day long, to every person doing 70 in a 55 zone. That is not about safety. It's about revenue generation...

To each his own!

I could see doing that if I was driving recklessly or under the influence, however 90 in a well maintained Porsche is neither of those. The suv and truck in the lanes beside me where doing the same speed, but since I was in a "Porsche" I was the one targeted, yes. I was also the one one with out of state plates and most likely the one to just pay-up and take the hit on my insurance. It was not about anything other than revenue. Period! I am not one to just roll over and take it in the ****, because you think that is not right.

"I am not one to just roll over and take it in the ****,...." YET "I paid her $350 to do her stuff"

Either way you look at it, you DID take it in the ****. She was just alot quicker and thanked you for it with a smile.

Let's say for an exaple: You in your 928 and an Enzo drive the same speed. Do you think you should be pulled over cause the other car is supperior?????

He's not guilty of anything until proven in court.

Cheaper to pay the lawer than pay fines, higher insurance, etc.

It IS cheaper in the long run to pay a lawyer and not the fine. BUT in either case you DO get shafted no matter how you look at it.

Did he "get shafted" or should he have "taken responsibility for his actions"?

All that I can add to BC's list of conditions for just paying the fine is, "if you think, because you sped, the government deserves your hard-earned $ more than you do . . ."

I deal every day with people who think "I should plead guilty because I did wrong." The problem with this thinking is that the criminal "justice" system has very little to do with "right" and "wrong," "ethics," "morality" or "justice." It's all about money and power and is, at best, amoral. If you want to confess, go to a priest. Or, as Richard Gere's character said in Primal Fear, "If you want justice, go to a whorehouse. If you want to get screwed, go to the courthouse."

No flames meant here, but...

I'm with Imo on this one. I'd rather pay the govt. for an offense I did then pay a lawyer. Lawyers have ruined this country.
