Well the battle with the 928 continues, I had been contacted by ICBC and the of course offered me a VERY small settlement, which I refused and I told them that I also wanted the car back, he asked for reciepts and I told him that I would supply some ads for 928s in the lower mainland showing there current value to be MUCH higher than he quoted,
so a couple days later (on the 17th) I dropped off the reciepts (including a $1900 reciept for the timing belt sevice) I then a couple days later dropped off the ads on a burnt cd in bmp format,

both times I left my # stating the best time to call me, neither time they did, I then caught a cold of some sort making it VERY hard and painful to talk (I am not over the cold) so I called them yesterday and found out my adjuster "bob" had gone on vacation and his buddy "brian" was dealing with the case now, so they put me over to brians voice mail and I left a message requesting a status and to find out what was happening with this as I would like to see a resolution happen. I also told him the best time to call me was after 4 however by his answering machine I understood he was off at 4, so I told him my last break is always at 2:45, he then calls me back at about 3:10pm, (ok brian lets think about this breaks are normally only 15 min how doesd that work) and he then tells me that he will try again later, nothing more, no updates NOTHING.

well I went home that night and checked my e-mail, and had a message from Mikri184, it turns out that they had sold my 928 to someone and that person wanted my keys to move the car. I contacted the person to confirm that he had my car, and I had requested of him to not take anything off the car, even though they had purchased it for dissasembly to not begin to do so as I had NOT given ICBC the right to sell the vehicle and it was still mine. He agreed and told me to call back with an update.
So I called ICBC on my lunch today and the cust service rep (didnt go straight to brian) and she said not only is the time rediculous, but the fact that they hadnt tried to contact me since I had dropped off the reciepts was unacceptable to which I agreed, she then connected me to a supervisors voice mail as none were avalible, I left a message stating that I hadnt been contacted, and that the vehicle had been sold and as far as I was concerned that was theft as I hadnt released the vehicle to them or signed anything saying they could sell it. I then called this supervisor after work as I hadnt heard back from him. I got through to him this time, he told me that he had my file infront of him at this time and that he was unable to do anything bu that he had directed it up to his manager, I also asked him where the fine print was located on the purchase of the vehicle that stated that ICBC was allowed to sell the vehicle before the settlement had been completed, and that I had already STRCITLY told Bob (first person I had talked to) that I wanted the vehicle back no matter what!, the supervisor asked me if I had come in and signed anything, I informed him the only things I have done is to drop off the ads and also the reciepts, I had not signed anything nor WOULD I that released the vehicle for sale! he said then no it shouldnt have been sold, so I said then "essentially then that is theft, correct?" he gulped and responded yes, followed by a ressurance that him and his manager would be going over it first thing in the morn, I told him that he hasd better get his butt towards getting that car back, and if I hadnt heard from him by noon that I was calling him.

So when I call him back tomorrow I am going to be telling them that if a large settlement isnt offered and the car FOR 100% FREE that I will be enlisting a lawyer, as selling the car w/o my consent is completely illegal.

So now I have a few cards under me I hope I finally see a resolution to this,

I must admit the supervisor was courtious however and neither of us were rude to each other.

oh and ICBC sold it to this guy for only $750 cdn, due to this and its time of being sold I believe it to be and inside job, and I am going to be making sure that whoever sold the car gets in MASSIVE amounts of trouble.

GIVE THEM HELL LIZARD. You should probably spend the $$ if you know a good attorney and talk it over with him/her ... time to be careful. All the best. I really hope you get your fair setlement so you can get the car fully replaced and also get yours free or at 750 CDN. That cold? That's why I couldn't make it up there recently ... I was out for the count, let's do it soon

Go git 'em, Lizard... Far too many insurance companies are slime. I hope you get to teach this one a lesson. Sounds like they were starting in with the "stall until he'll take any amount of money" tactic. It doesn't fix the fact that there's somebody out there still deserving of an ***-whupping.... but it sounds like you won't get screwed twice.

Oh, try to get a copy of the paperwork that the dismantler has on the car, before the ins. company can shred it.

Lizard, Get some kind of affidavit from the purchaser of your car and who he bought it from. You will have their nuts in a table vise after that. Trust me, insurance companies do not like being faced with paperwork. They love the he said she said stuff.

Lizard: So who has the title to this car? I mean in the states no one would consider purchasing w/o a title. I can't imagine it could be that different in the north. What would happen if you called the Mounted guys and reported it stolen "but I know where it is"?? Love to hear how this turns out.

Lizard be sure to check under the car to see where the tow truck drivers have attached their "hooks" they love hooking to the front steering tie rods , the rear flat lower control arm spring plate , and bending both of them . Also they typically break the front spoiler because the car is too low and after all it is just $500 worth of JUNK . Moving it without a key they drag the JUNK up on to a flat bed and if the wheels hit the siderails , they hit the side rails ; after all it is just JUNK . The spare tire , jack , air pump and stereo equipment often "migrates" as the JUNK is moved from impound lot to salvage lot (and back ). You will probably need to become a Gila Monster before this is resolved . The insurance company was trying to save a little money by selling the car and not paying daily impound lot fees but they did screw up big time since you had not signed a settlement agreement to transfer ownership to them . If you have written down notes detailing your telephone conversations as they occurred (and that is something you normally do ), should this end up in litigation (or the threat of) Those notes can be used to "refresh" your memory . Bob , Brian and the supervisors really do not want be confronted with what they actually said . So sink in your teeth and hang on keep trying to push it higher , supervisors supervisor because few people want their boss to have to fix their screwups .

well said jim, thanx, I am documenting the convos but have to do it a few hours afterwards, anyway I had seen the car after the first tow none of the rims were damaged in any way, the chin spoiler also was not touched and is still in perfect condition, I havent checked the tie rods, but will rip them anew one if they did, they were able to get in the car however and put it in nuetral so no damage would have been incured from that, I also have the spare tire compressor and a few other pieces, however the factory tool kit pieces were taken (too bad it was 100% complete) and all the stereo equipment was taken by the vandals, including the 500W RMS alpine V12, thank god I took the Blaupunkt ODwA 12 out of the car, I will have to check the rear trailing arms however, also the car is sold for dismantling anyway, they are not allowing it to be repaired so the title is pretty much crap to whoever bought it. however I still have the vehicle registration in my hand,

also I talked to them today and the supervisor states that they apperantly had been given permission to sell it, however I am the ONLY one who could have given them permission, and I KNOW that I didnt. so there is something wrong with that, I think that there is someone working inside there to get this to happen, I hope they catch and fire them overthis.
I told the supervisor that he should get my car back NOW and that I would recommend that they offer me a large settlement and GIVE me my car back for free, and that if they dont, or come up with an acceptable agreement that I would be getting myself a top Lawyer fast, he said that he will be getting the rest of the info on Mon, I told him that I would give him till monday to something together.

not to be the voice of doubt, but I would recommend removing all of these details and discussion until the legal battles are over; otherwise they might be able to spin some BS about a conspiracy against them if they found this thread. just MHO

I have never heard of such a thing happening before the title was transferred and the claim being paid. Is this sort of practice common amongst the insurance companies in Canada? Ownership is fairly black & white here in the States.

dealing with the government sucks, eh?

I ditched ICBC about five years ago and only use them for the manditory insurance. All my collision / comprehensive etc are through a private firm.

My only dealings with ICBC have been a hassle - they will not authorize proper repairs, only the bare minimum and they try to skimp on payment. I have a friend who had an 87 Turbo 944 that was written off while parked on the side of the road in Kits. They offered him $3000 since that was all "it was worth" - a perfect , <100k km leather interior with perfect body and paint. He is still fighting ICBC after about a year.

I personally hate ICBC with a passion... so since you have this one over on them, I say get the lawyer and hit them big... hell, even get the media involved if you can since the media loves this kinda stuff... ICBC and their thieving ways
Who knows, with a good lawyer, the settlement could net you a GTS, cash and then some :P
