I left a movie at 6pm on Dec14, and while checking Email in my car, I see a big *** white Yukon park beside me.
And he parked like an ***.
Yup, so..I'm watching the possibility of drama developing, and what happens...drivers door crams into my quarter panel, shakes the car pretty good, and I saw it all unfold.**
I get out and ask the driver to help inspect the damage, he says he has no time, it was his phone..and points to somewhere in the rubber wing area..."Cmon kids lets go!"
Take photos..a lot. I took a lot. This, that, the positioning of the cars, the closed door in relation to the missing paint -and- dent in the crown of the rear wheel arch..plate, his whole car, all of its dents and fault, the vin plate...then call the cops.
Also, leave a note...take a picture of the note, where you left it..etc..etc.
Long story short, the cop only ends up doing an incident report., which..is he called in for an Incident number, and gave me a card. Left a card on the Yukon as well *take photo of that too*.
Called insurance, they can't do much about the deductible without a report, and go get my quote from the shop I use, and they know...and now we're in a holding pattern attempting to get MVPD to do a report.
Quote comes out to roughly $3800 to R&R the whole panel...fine but I STILL need a police accident report to get out of my deductible ($1k)...assuming the other Insurance company accepts fault.
Takes about four trips to Mountain View PD over two weeks, and on the third trip I got someone at the window I had not seen before, and when I again patiently explained that I was IN my car, SAW** the whole event, and could ID the driver, things changed, she called in the original officer from his patrol to complete a report that evening (Dec 27th) and I could get it the next day. The original officer and other people I spoke with on other trips kept doing nothing after I left, "Because it was on private property" and they figured I would go away.
Nothing in the VC suggests that most accident requirements (operators and officials) change if they are on private property or not. Show insurance if contact is made..esp if requested, and do a damned accident report. This is why I kept going back. Pick different times of day, you'll get different faces at the station window...shifts and days on/off change up. The last straw is when you know someone who knows someone, to make a polite request do "do their job" but you dont want to use those. There's a retired San Jose detective on the Airport Board I work with a lot on a lawsuit against the local airport to gather data..so he kept telling me how/when to go back and keep trying..thanks JC!
With the proper report, the deductible was waived after the other insurance company (State Farm) accepted liability on the dense amount of documentation alone, and then MVPD called me back on Jan 3rd...

MVPD wanted to know for sure if I could ID the -driver-, so..I said yes. And shockingly they pulled a lineup, but it didn't last long. They were preparing a VC16025 (Refusal to show proof of liability) ticket, and a PC20002 misdemeanor hit & run. The traffic Sergeant got involved because the reporting officer didn't do his job..and the report rang bells that said 'what a dick' and with the damage amount and a direct clear witness...this is what they did.
I ID'd the fellow, I was asked if I was sure, I asked if each of the four could state how many children they had. Three said zero, my guy.."Ok..it was me, I have two.."..didn't get to the 5th person..which was a curveball, 4 guys, and #5, and old lady who...I doubt could get into a Yukon.
He can probably get out of the H&R, it wasn't "moving" but that may only apply to Felony H&R, I dunno. The car goes in for repair for ~3wks in the AM, and a long month of angst is over. Additionally the SR-1 filed with the state will likely cost him 90d of suspension as it was noted as a H&R tied to the police report.
My car had -two- chips on it, one was mine, the other was his (and a bit larger than mine). It's now down to one on the edge of the drivers door.

Persistence pays. Just food for thought, is this going to create any kind of negative entry on CarFax/vehicle history? Not 100% sure what I'd do in that situation but if there is a chance the car will be stigmatized, I would stick the "d!ck" with a civil suit on loss of value.

A door ding, nah. I asked USAA about that. Its only "collision" because it was another vehicle, but not a reportable incident...it's just a door ding as a matter of record, and a simple no-parts repair (Unless the quarter window seal fails).
One where a 3-layer thick 4.5mm rolled steel door edge hit 1.4mm of super soft 6010 aluminum along a wide unsupported panel.
If I sued for loss of value, that would be a PITA deposition to sit thru. I still drive the car somewhat..and I dont have collector insurance which would help greatly here.
And he knows who you are. People own guns, but you're in Cali so I'll change that to bad people own guns. He's probably not too happy facing a felony, so no need to push him over the edge. Enjoy your victory, don't taunt your opponent.
Remove & Replace a quarter panel for a door ding? That seems to be a sledge hammer approach. Or the body shop knows they have a blank check to do whatever they want. Is there paint damage? Would a good PDR place be able to massage it out?

The other party is a DB, and likely has gone through life doing various things to ****e on people around him. Real people can be in a hurry and make mistakes, but wouldn't have behaved this way after the incident.
Which, and here's where I'm placing equal blame, the first cop would know, because he's a cop.
The patrolman should have taken steps then and there, especially if there was potential for two parties to escalate tensions in a parking lot. And yes, guns are everywhere now.
I have two cops in the family, both would tell you this officer was being lazy. The call is the call, paper work or not.
Wow, that sounds like a real nightmare. Nice work on getting it resolved. Most people wouldn't have gone any further than calling their insurance. You achieved the best possible outcome.

Ya, but I was not gunna pay the $1k deductible...simply because I saw him do it. If I lost that fight, it would be small claims, and in CA if a judgement owed is over $500, you can have the DMV suspend a DL indefinitely until the judgement is paid in full. Under that, 90 days. The methods of collection are numerous and interesting as well.
