I have been following your progress but have not commented yet. I really don't have anything constructive to add other than I am sorry to hear what's happened. That really sucks! I feel for you trying to use the proper channels and all. It really makes you wonder if it is really worth the hassle to be an honest, upright citizen. I am quickly realizing that the only way to get ahead is to really screw the system.
On the positive side, you now have your car back. Even though the paint sucks and hopefully he did not damage anything else in the process or dare I say, sabotage anything. Now is the time to let loose. He is no longer holding anything ransom. Get in touch with every organization, agency, and inspector that will make his side business a living hell. Keep at it. You'll never get your money back, but revenge can be sweet.

Definitely sue him. Also, EVERYONE, please do NOT harrass the guy, as that will ruin Rob;s chances of a successful recovery. Rob, take that guys name/number offline, too.

Sue him. You were forced to pay for a paint job you are unsatisfied with. And you were forced by a judge with a conflict-of-interest to pay more than you had agreed to initially. Sue him. Get a good lawyer.

I wish you well if you attempt to sue, however in my area I will tell you that winning in court will be difficult. I had some issues with my old 944 after a repaint and I will tell you that after talking to my local judge it's going to be tough. Basically, its a "you get what you pay for" kind of deal and you really don't have much recourse unless you spent an obscene amount of money(over 5k).

Discuss your options with at least one lawyer. It will cost you you a few bucks, but in the long run it will be worth it. IMO you will not win if you just take him to small cliams. If you hire an attorney, he will be forced to do the same. File in superior court were you can can request a jury trial. Jurys hate scamming auto repair people.

At the very least, talk with an attorney. If your state has a Bureau of Automotive Repair, give them a call for advice/recourse. Talk with code enforcement if he's running an illegal shop out of his backyard.
If you do decide to pursue it further, start taking notes. Round-up all the records you have. Keep track of phone calls, dates and times. If you're well organized it will make it easier for you and anyone on your behalf down the road.
