You shouldn't need a law degree to understand basic legal concepts such a damages and what is or is not considered a contract.
Afaic, the OP's best chance at resolving the matter is through direct negotiation with the relevant parties at the dealership. Hopefully, they will be empathetic and do what is in their power to resolve it to the OP's satisfaction.

appreciate all of the advice across the board here. i think i'll first see how the dealer can correct the issue. hopefully they can at least fix the caliper color. my hypothesis on why they didn't sit with me to confirm the build is covid had already hit and CA was in lockdown mode. that said, the original SA confirmed they received and submitted my last build code and its only pure luck that it was mostly consistent with the prior build. one of many bungles during this order, including the new SA saying they had me for $10k over MSRP. fortunately, i had asked for a signed and written msrp guarantee months ago which instantly reversed that claim.

I'd involve lawyers only if malicious intent was involved, which doesn't seem to be the case. If an honest mistake was made and an honest effort was made to correct or compensate for it then the sky is the limit as to where two parties could agree to a mutually acceptable resolution.

Personally I wouldn't be doing any business with these clowns, this is the Porsche pitfall one falls into whenever they introduce new models and dealers look to take you for what they can.
They know people have to have the car and they charge "market price". Price to pay for exclusivity, it's your money to spend.
They've made it into an institution and we feed into it.
