Default Damage going through Car Wash

Anybody know who is responsible for the damage to the car and to the Car wash itself.
Would the car wash place be reponsible or the Car owner?

the whole thing is that the car wash had tracks. Its one of those type that tells you when to stop and if you go to far forward it tells you to reverse.
I did this. Following the directions from their cash wash lights. I reversed and while going in reverse the front tire skipped the rail and wedged up againts their stationary car wash with the spikes of the sprayers.
My rim, paint and light cover got scrached and cracked.
I ripped the aluminum sprayer spikes off the cars wash while getting the car out of being wedged up against it.
The car wash place thinks I should pay 500 big ones for their aluminum spikes to be fixed.
Lucky this was with my wife's range rover and the car wash is a touchless.

That's nothing....a few days ago, I saw a 996 fly by me on the Deerfoot doing about 130...they use gravel on the roads here in winter. I guess he doesn't give a **** about his car being sandblasted by flying stones...either that or it's leased!

Some years ago my car was damaged in a car wash. It jumped the track and got dragged into the machinery. The car wash paid for full repairs. I believe under the law, the car wash is responsible unless they can show that you made a mistake. In my case it was an automated facility and there was nobody in the car at the time.

I assume the car was is going to claim that you caused the car to jump the track when you reversed it. That may be tricky to prove and I believe the onus is on them to prove their machine was not responsible. get a lawyer.

regards,

I have no clue why anyone would ever put there cars through a carwash. You have to be kidding me.

I can understand regular crap cars, but a P-Car or something special. wow.

The next they will hear from you is in court.

See if they respond then.
