I was told that the + Active portion of the PDLS is not legal in the US and is therefore not active. I don't know if this can be turned on aftermarket.

OP lives in Kuwait. Not sure in which countries the lights are authorized.
I live In Kuwait but how to make sure that it’s active ..?
First, check that your Cayenne has the PDLS+ option. It is not standard equipment on the Base Cayenne. The PDLS+ headlights have a unique look as depicted in the picture, below. Second, determine if the PDLS+ is allowed in Kuwait. Not all countries allow the use of the active matrix feature (the +) of the PDLS+ lights. As Macanic posted above, our PDLS+ active matrix feature is disabled here in the USA. I looked online and couldn’t find if Kuwait allows them. If not, active matrix is deactivated on your Cayenne if it was delivered to Kuwait.
If PDLS+ is not allowed in Kuwait, you should still have the static cornering lights, dynamic cornering lights, and high beam assist available with the PDLS (without the +). You can test them at night in your local neighborhood. Just drive around a dark corner and look for the cornering light to illuminate and the headlight beams to shift in the direction of the turn. To test high beam assist, first have your headlights set to High Beam Assist as indicated by the green icon with the “A” in the center (pictured, below). On a dark road without streetlights, your lights should automatically change to high beam and dim when another car approaches or you are following another vehicle.
If you have PDLS+ installed and it is allowed in Kuwait you will have to find a dark road out of town to test the active matrix.
Look at this video, especially at 0:50. It shows the lights dimming around the oncoming car and then after the car passes, if you watch carefully, you will see the lights again illuminate the entire roadway.
PDLS+ on my '21 GTS. I have found that in order for the intersection lamps, side illumination, auto beam adjustment to work the rear fog button must be pressed. It is wonderful to have the side illumination automatically come on when entering dark streets or my neighborhood streets.

There is no connection to the rear fog light. Side illumination, etc. is dependent on speed, steering input, ambient light. I have PDLS+ on my 21 Base and it reacts differently under streetlights vs. dark, etc.

Then why do the functions not work without rear fog active? If I press the switch while driving the functions disappear.

Agreed. XLR82XS - You may wish to have your vehicle’s lighting switches checked out - they may be wired incorrectly. You should only need to have the automatic headlights switched on:

The functions are still there just not nearly as noticeable as the switch you are pressing directly illuminates the side of the road. I have begun turning on the fog lights every time I drive at night as the side illumination they provide is really incredible. I have never used the fog lights in any other car as they only helped with forward view, these are totally different and I think that is probably what you are noticing.

You should leave your headlights set to Auto (green icon with “A” in the middle). I always drive with mine set to Auto. The lights will be dimmed until the system detects a dark road with no vehicles. The system will then automatically set the lights to high beam. Your display will show both the green “Auto” icon and the blue high beam icon simultaneously as indicated in the screen grab from the video, below. When a car approaches you, the system will automatically dim select LEDs in your lights to form a dark spot just around the approaching car. When the car passes, the LEDs will again illuminate the entire roadway.
When you manually override the Auto setting and switch to high beams, you will not have the auto dimming feature active. This can be useful when you need more light in areas with streetlights.
One more thing - You may have wondered what the “Inverted” setting of dipped [low] beam is used for. This is only for use in countries that drive on the left side of the road. Selecting this will dip the right beam more than the left - just the opposite of how it works for driving on the right side of the road.

While in Auto, when I pull into my garage, the dipped beam indicator is illuminated and I take this to mean that the lights are on low beam. Here's a clip from p 140 of the 2021 manual:
